If you have a pay back amount of 20,000 and you can only ever have 10,000 of it?

lets say they made a mistake, they should have paid you 20k but because u are not allowed to save more than 10 k they now can take away the 10k amount even though they made a mistake?

If its benefits related, which benefit and back pay from what?

Just an unusual situation where DWP makes a mistake or you do not do anything wrong.

But you had benefits cut for a time period.

So they pay back what they owe you.

But lets say you have 9000 in the bank already and they owe you 5000, would they just pay you 1000 (assuming 10k limit) if they knew you had 9000 saved already?

Or if the limit is 10k is the payback limit also 10k?

You would be paid the whole amount they owed you, regardless of how much money you have in the bank.

Afterwards, there are rules that disregard benefit backpay from counting as capital, for either 12 months or indefinitely depending on the circumstances.
