Appeal lodged regarding backdated pay - How safe is my award?
Hey,
To provide some context I was awarded Enhanced ADP Mobility but it should have been backdated to Dec 2024 rather than July 2025 as they have done.
I received the response from Social Security Scotland and they have agreed with my appeal, however, this looks like it still needs referred to a tribunal as per the process. They did state in their response that they would prefer a paper hearing on the matter if that makes any difference
Am I potentially putting the award at risk by pursuing this?
Will this simply be a case of the Tribunal accepting the position of both parties or am I in a position where I will have to defend my full claim?
I am aware that if the tribunal disagrees with both parties then they can overturn, but not sure how often this happens.
Any advice or experience would be appreciated
