ESA appeal letter

thankyou all for the advice ,youve given me ,,just one more thing ,i recieved the madatory paper from the esa ,,but when i spoke to the tribunal office ,they said i should have got a copy of what the esa sent to them ,is this the same letter or is it a different one ,as when i rang esa they said they would send me a copy of what the tribunal got from them ,but not recived anything more from esa

I'm not 100% clear what you're asking but...
1) ESA should send you 2 copies of the mandatory reconsideration. 1 for you to keep and 1 which has to accompany your SSCS1 appeal form.
2) ESA send HMCTS a submission plus the evidence they have. This is your appeal papers. The paperwork the appeal hearing will consider on the day as well as your verbal evidence or that of your representative. Any further evidence sent in from now on needs to go to HMCTS and they will distribute it to all parties rather than ESA.
When ESA sent the submission to HMCTS they should also have sent you a copy. If they have not then you can either contact ESA and point out the failure or ask HMCTS for a copy of theirs.

hi all just to let you know ,i went to tribunal yesterday and have won my case and backpay granted to me ,thankyou all for the advice which has helped me through this odeal

had my confirmation letter from the tribunal,a week later had nothing back from esa, phones them today ,they said ipapers gone to considerations department ,will prob hear something by next week ,this crazey,when they know what they owe me ,do they not think ive waited long enough to get my bills payed upto date

DWP usually take 5-8 weeks to put a tribunal decision into payment. They have four weeks to decide whether to appeal the decision, the first stage of which is for them to ask for a statement of reason.

When you apply for ESA you will need a fit note up until the time a decision is made. That’s after they have your ESA 50 and you’ve either had a face to face or a decision on the existing evidence. If you qualify you’ll no longer need a fit note but if they then subsequently find you fit you’ll need fit notes again whilst you challenge the decision.

Actually many people would now employ you as they would have a potential EA10 issue if they refused to even entertain the idea. -
