Hi, I'm Robert1111. I've been awarded PIP. Can I ask for a review of a previous unsuccessful claim?

Can anyone answer this question for me please. I applied for pip in 2018 and was refused and done a mandatory reconsiderion but was still refused. Then in 2020 I applied again and was then awarded standard rate for the daily living. Nothing at changed in this time and my medical conditions had stayed the same. Do I have the right to ask pip to review this as I should or been awarded this in 2018 surely? Any advice would be appreciated

@Robert1111 afternoon and welcome to scope.
You did ask them to review it in 2018 (MR) and they didn't make an award, you could have appealed that decision at the time. So I'm afraid they won't review the old application even though you now have an award (which is the good news).
Don't forget that PIP isn't awarded for medical conditions.

Hi @Robert1111 - & welcome to the community. Unfortunately, following your Mandatory Reconsideration, you had the opportunity to appeal further to a tribunal, which you presumably did not do. I'm pleased you were awarded PIP in 2020, but sorry you hadn't been awarded earlier.

Thank you for replying. I understand that. On my new claim I was awarded 11 points for the daily living and 4 for the mobility. After reading articles about the leap reviews and the changes in the law, is it to late to ask them if they could review my present claim as it was a year ago I was granted it?

As others have advised, unfortunately you wouldn't be able to ask for a further review of the previous unsuccessful decision as it wasn't taken to tribunal at the time. Although it's possibly little consolation, I'm pleased to hear your most recent claim resulted in an award
