Mandatory Reconsideration phone call..

The decision maker called me yesterday and told me after the mandatory reconsideration I have been awarded standard care and enhance mobility to be reviewed in 8 months. Although I appreciate the award, why would there be a review in 8 months?

They can review you at anytime. If you're not happy with the length of the award you can request the Tribunal for just this but you need to make sure you state that it's just the award length (if you're happy with the actual award itself)

You can appeal the length of the award if you wish to.

@xPaganx I'm so glad you've been awarded. I've done a mandatory reconsideration and it got logged last Monday 7/02/2022 I'm hoping they give me the outcome I deserve 🙏 it's been a long wait since August last year to be turned down one thing I never knew they phoned you to give you the decision. I want to know I'm anxiously waiting

I can’t stress heavily enough how much help I’ve had with this. The best thing is not to do it yourself but get help from someone who knows how to word things. The woman who did mine was worried because I couldn’t provide anymore health details (I only had the ones from my doctor) and she did warn me that it might not go through but she worded it so well and emphasized so much on where the last decision maker had made so many mistakes, she was amazing.

I think "deserve" is the wrong word to use here. If this were true then everyone with a disability would be entitled to it but that's not true.
To be awarded PIP you need to meet the descriptors in order to score enough points for an award. There are some people that have a disability but don't meet the descriptors so there's no award.

Just want to say that there is no right or wrong way to word things as long as the information is conveyed along with examples of the difficulties experienced. I understand completely however how daunting the process can be and that some people will find it reassuring to have others help them

@poppy123456 I'm sorry if it upset you with me writing the word "deserve" I didn't think I had to watch what I said. All I meant is ive been waiting over 7 months and I just want the outcome I deserve as its been a stressful time with waiting etc as caused other issues

You never upset me at all and i never said you had to be careful what you say. I claim PIP myself but not because i deserve it. I claim it because of the way my conditions affect me mean i scored enough points needed for an award. I stand by what i said and no one "deserves" to be awarded it.

I understand what you’re saying but I did a terrible job of doing the form the first time round. I’m not really good at any of this stuff. When doing my mandatory reconsideration the woman actually reference previous law cases and stuff. I wouldn’t know where to start with all that.

I understand. As to quoting previous cases, I really don’t think that is necessary for a the MR (although referencing relevant guidance can be). Previous tribunal decisions are more relevant at tribunal stage.

Maybe they are but I knew absolutely nothing about any of this and I’ll praise her up and down because I went from no points to the points required to get standard care and enhanced mobility. They refused my case for multiple reasons that were untrue and the fact that I weren’t taking opioid medication prescribed because it did nothing for my pain and just made me feel incredibly high. Also because I hadn’t been referred for pain management or the fact that whereas I’m trying to attend physiotherapy sessions but it’s been a waste of time because I’m in way too much pain for her to even touch me.

I applied in April last year, Sent my MR in December, And they have said there's Back Logs and I should receive a decision before the Middle of March, Its not nice waiting so long, I received 0 points so I'm not too hopeful on the MR.
