Pip change of circumstances

hi , my name is andrea , i had a review decision for my pip in august 2021 , when it came back I had lost some points ( was on standard for both parts ) still on standard for both parts but was annoyed that I had lost points , went from 11 daily living to 8 , mobility was increased from 8 to 10 , did a MR and got my points that I lost back which I was happy about and satisfied but on the report from the case manager there were a few flaws , the worst one was that the HP stated I had hand rails in my garden so that proved I could grip ??? Well I’m sorry but I have lived in this house for 32 years and never had or seen hand rails in my garden 😂, any way I rang and asked to speak to a case manager and went through the parts that I disagreed with , he told me he couldn’t do anything and I could appeal or wait until later and ask for a change of circumstances later , I didn’t appeal as I felt I couldn’t go through it , I have active rheumatoid arthritis which is still in progression and copd as well as other minor things , I was taken into hospital in October with a suspected stroke , turned out to be a TIA then a week later was admitted again with double pneumonia and sepsis , was ventilated and intubated for 2 weeks and in hospital for nearly 3 months , it has left me with critical illness myopathy and other problems , I rang dwp and told them about my hospital stay and had money to pay back for the over payment , the adviser also sent me the forms for a change of circumstances which I sent back with loads of other evidence but what I did as well was put in a letter about my last assessment, saying I wished to clarify a few points , I didn’t call the HP a liar just said things like she failed to mention or she must have misunderstood, things like that , what I’m wondering is will the call that I made to the case manager be also on my file to prove that I did disagree at the time ? I haven’t heard anything back yet but it’s only been 6 weeks since they received the AR1 , the last one took 24 weeks altogether …. sorry for the long post

Hi,This is classed as a new claim and your call to the case manager will have no affect on your change of circumstances.6 weeks isn't long at all. There's currently huge backlogs and it could potentially take several months at least before you have a decision. Most people have assessments either through telephone or face to face so you should expect one of those. Paper based assessments are rare.0

As you probably now realise your entitlement to be paid PIP ends after 28 days in hospital which is why your have been overpaid. Importantly your PIP award doesn't end, it's just the entitlement to be paid which is suspended. As soon as you are discharged you are entitled to be paid again in accordance with the award.
I don't think your comments on the last report are likely to make any difference. Your change of circumstances will be assessed on the information you have provided on the AR1 plus any supporting evidence you have submitted. Quite probably you will be required to have a new assessment prior to anyone making a new decision. You continue to be entitled to your existing award until such time as a new excision is made.

thank you calcotti, I have sent plenty of supporting evidence right back from January 2021 when my last review was sent , there from my rheumatologist and respiratory and doctor plus all the discharge letters and hospital and all the reports , do you know if they look at the letters that were sent with my last review too ? , the advisor said I only needed to send supporting evidence that they have not seen before , which is what I did , if they do class it as a new claim , as poppy said, should I have sent ALL letters right back to 2014 ?0

(I don't usually disagree with poppy but) it's not a new claim.
If your supporting evidence covers the last year i would expect that to be sufficient. most clinic letters refer to medical history and/or other diagnoses anyway. As we say repeatedly PIP is not awarded on the basis of diagnosis but on the impact your health conditions have on you.
