Pip help mandatory reconsideration

Hi my daughter had applied for pip with my help and been refused we received the letters back from the interview and it seems to focus on the fact that she had obtained some GCSEs and a driving licence before her mental health deteriorated I am her main career and help her with her daughter and her care. She lives alone but me and family members help her which she has stated. On her forms it reply’s to nearly every single answer because she has obtained a driving licence and qualifications she is capable. She doesn’t drive or leave her home she stays in bed daily except for helping with her daughter which she needs prompting which she stated in her interview. She said that I help her with care, I take care of her finances because of her past getting into major debt twice and still they refused her and said that she is capable because she obtained a driving licence and qualifications she didn’t obtain any qualifications above a-d in GCSEs. What should I help her write out in her mandatory reconsideration to correct this? She stated that her mental health started in 2017 due to the loss of her 5 week old baby and she now has ptsd, anxiety and depression due to this.

     Hi @helpplease112 - & welcome to the community. I'm so sorry to read about the loss of your little grandchild, & the impact this has had on your daughter's mental health.

    As far as PIP goes, it's not about any diagnosis, but rather how your disability affects certain activities of daily living &/mobility. Have a look at the following link that altho it's about filling in a PIP form if you have mental health problems, will still be relevant for your daughter's Mandatory Reconsideration.     Give a couple of recent, detailed examples as to the difficulty your daughter faces for each applicable descriptor, i.e. when did it happen, where, what happened, did anyone see this, & were there any consequences to attempting/doing an activity? Say if she needs prompting, support/assistance, or supervision.

    Say if she can't do an activity 'reliably,' i.e. safely, to an acceptable standard, repeat as often as one would reasonably expect, or if it takes her much longer than someone without a disability.

    Put the Mandatory Reconsideration in writing, & ensure your daughter puts her name & National Insurance number on each page. Keep a copy, & get a free Certificate of Posting from your Post Office when sending it off. Please come back with any questions.

    I know that’s not considered. But what I’m more worried about is the fact that they focused on her being a mum and not actually her daily life and struggles that she stated in her interview and focused on her qualifications and she obtained a driving licence when she was in good mental health and 5 years on she isn’t mentally able to cope with doing the daily tasks and I’m caring and helping her she doesn’t leave her home, terrified and anxious panic attacks etc. it seems like they focused on her previous ability’s and not what is happening now.

    It does happen but you need to put all that to one side and not focus the MR on those. Same for Tribunal if it gets that far and potentially it will.
    What you need to do it state where and why you think she should have scored those points. Focus on those real world incidents mentioned by chiarieds above.

    Hi there 

    The success rate at MR is quite low though some do get a positive outcome 

    Success at tribunal is a lot higher

    This is what happened to me, The assessors report Focused on me holding a Driving Licence, Near enough every part of the Report mentioned this, I told the assessor I use my car for short journeys and I'm always with someone, I cannot follow directions, And none of this was even written in the report, After a Mandatory Reconsideration I still got 2 Points, I've took it to a Tribunal and sent further evidence, Just waiting on a reply now.

    Chris have you heard back yet? it’s so frustrating when you are documenting everything all there needs care and they focus on a driving lesson my daughter doesn’t drive anymore she’s had panic attacks and cannot mentally cope with it. Doesn’t leave the home now and I told them that but they focused on her obtaining one before all the trauma happened.
