Hello!
Today I won my case at tribunal - from “fit to work” to LCW.
Dissapointed as was hoping for LCWRA.
Basically it sounds silly - I was awarded LCW because “can walk 100 metres” without significant pain. To get LCWRA i should be able to walk no more than 50 metres without significant pain 🙄🤦🏻♀️🤣
During tribunal I said I can’t walk 1 meter without significant pain - it’s constant, I just move around somehow ignoring it and on pain medication, because otherwise I will be stuck in 4 walls permanently. There is no difference is it 10 or 100 metres to me - pain is constant.
Have all medical evidence - xrays, doctors letters, descriptions of my condition etc clearly showing I have broken metal scew in my knee poking from inside constantly, and it does not matter if i walk or not - it is there at all times and obviously it hurts, it’s not like it dissapears and than comes back again after I have made that 51-st step! 🙄
Is it worth to appeal First Tier tribunal decision in this case or I should be happy with what I got today?

Before you can do anything else you have 1 month to request the statement of reasons and record of proceedings from HMCTS. Once you receive these you need to find someone to take a look to see if they can find the error in law. Start here https://advicelocal.uk/You can’t challenge the decision just because you disagree.Do be aware that the mobilising descriptor does look at your ability to use a manual wheelchair, it’s not just about your ability to walk.0
