Blue badge parking time limit + residents only

Hi, 

In general (appreciate that I'd have to check the local council rules too), if a bay has mixed us like the picture below which is "Permit Holders Only" or "10 mins No return within 1hr" , can I park here for as long as I need with the blue badge? 

I know I can with standard time limited bays but with a mixed use, does this change anything? I'm trying to find definitive answers online to this but struggling

No, because it’s permit holders only. If you don’t have a permit it’s maximum of 10 minutes.

Usually blue badge holders are excluded from time limits on parking bays, unless there is a specific time limit stating otherwise specifically for disabled users, for instance maximum 4hrs in a disabled bay. 

By my logic it should be fine to park here for longer than 10mins with a blue badge but just struggling to find definitive guidance online.

Question is whether this rule changes if it's a mixed use bay such as Residents only OR time-limited bay.

In my area blue badge holders are unable to park in areas where it’s permit holders only. 

Time limits on parking bays etc is completely different to areas which are parking permits only. 

You need to look at rules of the local Authority for where you want to park, rather than at a different local Authority.

The screen shot above where you've circled has nothing to do with parking permit areas. Parking permit areas are not places where all motorists can park.

The bay in question is shared use.
It is residents only parking without time limit but is also for public use for 10 mins, no return in 1hr. 

Appreciate not all councils allow blue badge for residents parking only bays (some do), but it's the public use portion that I am questioning.

Usually a public use bay that is time limited (but free to park) can be used by a blue badge holder with no time restriction. What I'm not sure about is whether this is still the case with a shared use bay as per the picture. 

I've reached out to the councils parking department for an answer.

Hello @johnadams1234 I'm glad to hear you've reached out to the council, hopefully they can clarify this for you. 

As someone with my own blue badge, I appreciate it's not always clear what rules apply where, and it's frustrating to have to ask around to find out, but I hope they can explain it for you in due course.

Just to close this thread, the council have informed me that I am able to stay in this bay for as long as I wish with a valid blue badge. 

Moreover, it appears that any shared use bay should be useable due to Section 9 exemption clause of section 45 and 46 of the Road Traffic Regulation Act 1984. 

The Local Authorities' Traffic Orders (Exemptions for Disabled Persons) (England) Regulations 2000 (legislation.gov.uk)

This basically means that shared use bays should always be free with no time limit.
This was the authoritative information I was looking for.

Which does go to prove that all local Authorities do indeed have different rules, even when it comes to parking and BB.

That legislation covering shared bays is for all UK+NI.
Residents bay use, yes, check council.
