UC and LCWRA. I've been told I don't qualify as my earnings are too high. Is this correct?

Hi, Myself and my husband are jointly claiming universal credit.  My husband works full time, I work part time.  I have been off on SSP since February.  Had major surgery now having physio, it’s going to be a long road of recovery.  I have asked about LWCRA and the work coach has said I don’t qualify for a referral for a work capability assessment as my earnings are too high? Is this correct? Thanks.

If you are earning more than 16 x NMW/week then you cannot be referred for a WCA (unless you have certain health conditions).
However if you are on SSP only you are below this threshold.
Your husband’s earnings are not relevant when applying the threshold.
You should be referred for a WCA. They should have referred you 29 days after you first informed them of your health condition (if you were on SSP only at that time).

To be referred for a work capability assessment your earnings must be less than 16 x NMW/week for yourself (unless you're claiming a disability benefit such as PIP or DLA). If it's just SSP you're claiming then this is less than that amount, so you can be referred for a WCA.
