Hi guys I’ve a few wquesyions I need answers too. I’ve got a lwc assesment next month and wondered if I’ll still get my back pay if awarded. I’ve had fitnotes from January when my claim was made, I have a wca assesment coming up n expect a decision by December. If I submitted a fit note 3 days after current one expired Does “fit note accepted” mean that gap doesn’t make a difference and the fit note is valid? I just wondered Would this effect a back payment in any way, thanks

Thanks for making this post, how are you?
As far as I understand it, the fit notes need to be continuous, so without any gaps in coverage from the date you reported your condition. I would assume that having a gap of three days would impact any backpay owed, though I'm not certain on that.

We’ll that sounds great. It wasnt my fault.. The fit note was submitted late as my usual doctor was on annual leave at the time. Also I reported my condition in January and was not given a lwr assessment until I made I made inquires in June in regards to a sanction that was placed on my Uc. I Honestly don’t feel in the best of moods atm, isit me or is it fair to say that my sanction is unjust as I’m not physically or mentally able to make job centre apt’s? I stated in January along with fit notes that I’m unable to attend and only in June did they put me foward for a LWRCA but I’ve been sanctioned and haven’t had any form of income since June because of this. It’s been 2 months since my mandatory reconsideration and haven’t heard a thing back, I’ve fallen behind on my service charges and face eviction,. But thanks for asking0

Ross is correct and usually they ask for fit notes without any gaps until a decision is made on your WCA. However, as it was just 3 days the decision maker may decide to overrule that and start your claim from when you reported your health condition in January. If they do and you're found to have LCWRA then your extra money will be from either May or June, depending on when you reported your health condition.With regards to your sanction, if they've left you without money since June then that's disgusting. If it was me i would be contacting my Local MP. No one should be left without money to live! You can search for them here https://members.parliament.uk/members/Commons i'd advise you to email them and tell them about your sanction and that you've been left without any money to live since June. Hopefully they will be able to contact UC on your behalf and get this all sorted for you.

I handed my first fit note in on the 5th of July and have passed the assessment period. They told me it runs from the 28th July and first payment will be December.. does this sound correct? Kind regards0

You haven't given enough of information for anyone to be able to help. What date do you usually receive your money each month?

Your decision was made extremely quick. Your waiting period will be July/August, Aug/Sept, Sept/Oct.. LCWRA starts from assessment period 28th Oct to 27th November and first payment will be 4th Dec. This mean you were informed correctly.

LCWRA will increae your maximum UC entitlement by £354.28/month and in December you will receive 1 payment. You're not owed any LCWRA element because it's not paid at all during the waiting period.

UC is always paid 1 month in arrears, that's why you receive your payment after the assessment period ends. You're welcome.
