i placed a mandatory reconsideration in , on a award from pip .
after calling pip with new conditions to be taken into consideration on my reconsideration , pip refused to take the details of me over the phone and said , we have sent you a form out on the 29,09,2022 put all your conditions on the form and we will forward this on to the right department , i called pip and no letter has been sent out and pip now tell me a decition has already been made , after refusing to take the details from me . even the manager and team leaders from pip are lying to me about the reconsideration i have tried to place . no one from pip will talk to me other than team leaders who lie about forms and letters that have not been sent to me but said there is a post strike thats why this post is delayed . other pip workers said theres no post been sent from pip . what a carry on , what can i do ????? .

If the new conditions mean your existing conditions have got worse or you didn't mention any of those conditions in your claim then they can't be taken into consideration for the MR or for Tribunal, if you proceed with that claim. They can only take into consideration what your conditions were like at the time the assessment took place.If you rang to report new conditions then it is very likely that they took this as a change of circumstances and it's prompted more forms to be sent to you. You have to be very careful when reporting any change of circumstances.They are correct that there was a postal strike last week and various others in the past few weeks so this will have delayed any post being delivered. Even under normal times it can take a couple of weeks to receive forms from PIP.Please also be aware that when you ring PIP you are speaking to someone from a call centre, not someone from DWP itself.0

i did mention the new conditions in my claim , but because the mri scan result was not back to prove the conditions , the conditions i reported , were not taken into consideration on my claim , it was pip who told me its a mandatory reconsideration i needed after reporting my conditions , but pip logged nothing i told them . pip told me a form was sent out to me for the reconsideration , no such thing , pip has sent nothing as the pip manager told me this yesterday . pip are refusing to add my conditions to the system . now they say a decition has been made after refusing to add what i was disagreing with in the madical assesment report .i said this is disgracefull and i will take this to court for how they treating me . refusing to add details when it says you must tell them of any changes , when i try to tell pip my changes they dont want to no .0

You should be the MR request in writing, rather than do this over the phone. You could have wrote a letter with that request stating where and why you think you should have scored those points.When you request it over the phone, a decision can be made at anytime.PIP isn't about a diagnosis, if that's what you were sending them. Very often a diagnosis is not in question anyway.You can now request the Tribunal once you receive the MR decision. Please remember that it's not a court, it's a Tribunal. Much different to a court and you're not on trial. i did explain to pip that the information i had to give them, was to prove what i stated in my former claim was true . anklosing spondulitus , and a patruding disk . i have no gell type substance in between my spine column due to 25yrs driveing plant macheinery. and my spine is trying to fuse together . the evidence i was trying to put over is , hear is the evidence of my upper back as stated in my application . but pip refuse to take this evidence . and made a decition without putting the new evidence over to the mc team .0

The likelihood of the MR decision changing even with that new evidence was extremely slim anyway, most MR decisions remain the same. All you can do is proceed with Tribunal.1
