Were the backdated fit notes accepted? If they haven't heard about that yet, when the extra money is paid from exactly will depend on when the fit notes were sent without any gaps.All they can do is put a message on their journal under the payment section and ask.0

His case worker responded saying sorry she was wrong he’d get it this month that he will get it in January because there’s a 3 month assessment period wait, I’m so confused as we’ve already told her that that’s the waiting period from the start of the fit note0

It's impossible to advise because you haven't said what date the health condition was report/first fit note sent. You haven't said how long the gaps were in the fit notes and you haven't said whether a decision maker has accepted the gaps in the fit notes.Yes, the waiting period starts from your first fit note but as i advised gaps in those fit notes can affect when LCWRA is paid from.0

I don’t know yet if they have accepted the fitnotes or not, the decision is still in process. First fit note Was April 7, and there was a 8 month gap, ap 8th to 9. But thanks I do understand now that it depends on the decision on the fitnotes as it’s been a really long gap, thanks for your help

They are exceedingly unlikely to accept an 8 month gap, you previously said a couple of months. However a 8 month gap would take you to this month - is that really what you meant? What date did the continuous run of Fit Notes start from?0

Ah my bad, there’s a 4month gap, I got mixed up and said 8 because he also got more fitnotes untill this month just incase they end up blabbing about that. i belive the gap in the fit notes are June July August September but I’m sure it’s 4 months0

I see no point continuing with the fit notes going forward because they are no longer needed. Their decision letter would have also advised this.

If they are taking the run of Fit Notes as starting in September then payment in January is correct.0

hi again, my friend got the MR decision for the back payment, did i understand this correctly, he isn’t awarded the backpayement but will still carry on getting the 350£ monthly?

In the normal situation
He reported your health condition on 09/02/2022.
The LCWRA status should apply from that date.
The 'relevant period' before the LCWRA element is payable is therefore 09/02/2022 until 08/05/2022.
The first full assessment period after that date is 09/05/2022 to 08/06/2022. The first LCWRA payment is therefore due on 15/06/2022.
However you said that the UC 50 was originally not returned and there were some gaps in the Fit Notes which could revise the above sequence as previously advised.
You haven't posted the complete letter so we cannot tell if the delay/gaps are the reason DWP have made their decision they way have. We can't comment properly if we are only seeing parts of the letter.

sorry mistake, *he recieved his first 350£ this month january. my only concerns are if he still has LCWRA and if he will still receive the element monthly, thanks x0

LCWRA still applies because that wasn't the reason for the MR. The reason the MR was requested was because of the waiting period. They refused the MR because there was a gap in the fit notes which wasn't accepted because reminders were put onto their journal.They will continue to receive the LCWRA element going forward.0
