Ehcp for physically aggressive autistic child ?

Hey 👋🏼  I've been on here before my eldest son , now I'm back again for my 3 year old son who is due to start school in September!  Academically he is very bright can read books and knows French,  but he is angry and constantly bites , spits kicks hits , has unruly behaviour at home and nursery. He has had intervention from isend.  But nothing has worked ! Today I was told by the nursery that isend haven't referred him for an ehcp. Isend phoned me and explained that they didn't realise the severity of my sons behaviour , and after seeing him in action do believe he needs support for his transition to school and in the classroom..  the cut off line for them to apply for ehcp was 31st of October! But parents can apply with the help of the nursery! The nursery are not happy isend hadn't applied for an ehcp ! Can you get an ehcp for a autistic child with aggressive violent behaviour?

    Individuals don't get an EHCP based on their area of need. However, individuals do tend to be eligible for EHCPs if:

    • They need support that would not be available within the same setting within the usual resourcing
    • They need support that would not usually be available to other people of the same age

    In nurseries, EHCPs are less common. This is just because nurseries tend to be more flexible in their approaches and resources available and tend to rely on an attachment figure (such as a key worker).
