Need help figuring out backdated payment.

I was recently awarded LCWRA at tribunal two weeks ago but I am still waiting for the backdated payment to arrive. My advocate said that the DWP may try to get funny about the dates if I have any holes in my fit notes so I have gathered them up and have found the following dates:

29/07/2020 - 28/10/2020
28/10/2020 - 04/02/2021
04/02/2021 - 17/03/2021
17/03/2021 - 05/06/2021
06/06/2021 - 05/12/2021
05/12/2021 - 09/03/2022
22/02/2022 - 21/05/2022
21/05/2022 - 20/07/2022
20/07/2022 - 04/10/2022
No need to present any more sick notes

There is a 1 day gap between my fit note issued in June 2021, would they take this as the date that they're paying me from, or will they see that it continues from the next day and just take it as no gap? The dates usually overlap so I'm unsure.

Also I know that the claim is backdated by three months, does this mean I'd be due from October 2020?

I had to merge my claim with my partner at some point within these past 2 years (I think August 2021) and I cannot see my initial claim. Will they try to say that's when my claim started or will they consider my claim as a single person too?

This has taken so long so I want to know where I stand. Anybody got any idea?

Depending on the date you usually receive payment each month then you should receive money owed from either Nov or Dec 2020.
I wouldn't expect them to do anything regarding the 1 day gap in your fit note.
However, as you claimed UC with your partner during this time there could be issues with backdating it from before you claimed with your partner. Did you take screeenshots of anything related to your journal before you claimed with your partner?

I do not unfortunately, I was prematurely pressured into merging claims by the person on the phone for UC.

At the time, my partner was in hospital and I was simply housesitting for a few days, but the UC coach threatened to take my UC away if I didn’t merge the claim.

We weren’t together at the time, I was just there to feed her cats whilst she had surgery…

I’ve taken screenshots of the amounts from the joint claim before they change the amounts post LCWRA but nothing from that era saved

If you were just house sitting at the time then your work coach was wrong to tell you that you needed to claim as a couple at that time. You can have a partner but not live together as a couple, which is perfectly fine when claiming UC.

Yeah I tried my best to explain that to him but I'm not so good at explaining myself without a keyboard. The situation was too stressful to handle so I just did what he said.

It sounds like you have a really difficult explaining yourself @wizboque, especially without a keyboard.

Are there any alternative or augmentative means of communication you could use to explain it to him?

I am just wondering what might help you to explain it to him in a way that is accessible and comfortable for you.

Please feel free to let us know if there's anything we can do to help. We are all here for you and listening to you.

You don't have to face this, or anything else, alone if you don't want to. Take care for now and we will look forward to, hopefully, hearing from you again soon  :)

Just to clarify that was a year ago, they made us merge a long time ago and now it’s just how things are. I was just wondering if they’d be considering my notes from when I was a single claimant

Just called to see what’s going on and apparently there’s no notes whatsoever relating to my tribunal. It’s been almost 3 weeks now.

is there any way to expedite the process? We’re currently being threatened in our home (by people who committed an aggravated burglary on our house previously) and the police have told us not to leave the house until we move but that can’t happen until this payment is in place.

HMCTS should have sent DWP a copy of the decision letter the same time as they sent yours. If you have a copy of yours then you could send this to DWP. After a Tribunal decision it's not unusual to wait around 8 weeks for any money that's owed.
