Backdated lwcra

I have been an impatient since May 2020 at a medium secure hospital and only just received the lwcra award in September 2022 I have gone for a tribunal as UC said they will not backdate me to the prior date and are currently waiting for a hearing date as i have been an impatient since this time do u think i am legible for a backdated payment from may 2020 to september 2022

    When did you report your health condition to UC and did you supply continuous Fit Notes to support this?

    The LCWRA element itself is only paid for the first full assessment period that starts after the date which is three months after the start of the LCWRA status which begins from when the health condition is reported.

    I applied for universal credit in may 2020 as a mental health hospital inpatient and my original fit note dates back to january 2020 when i was first admitted

    But i was supposed to get the WCA questionnaire 3 months into my application for universal credit but i only received it in june 2022

    When you got and completed the WCA form is not relevant. The three month wait is from when you notified UC of your health condition.

    If your ill health was notified in January 2020 then the LCWRA element should be payable from May 2020.
