Have just been in touch with Dwp regarding wifes reinstatment of enhanced mobility award. No great surprise that we have been told to ring back on the 25th Sept as at present its with the manager???(only one manager??)However they did admit (probably reluctantly) that they have recieved the Tribunals decission to reinstate full enhanced motability. But it is the manager who makes the final decission??.How can they decide to make a decission when they already did make a decission in reducing my benfits in the first place, and secondly they had the opportunity to turn up at the Tribunal to explain their decision in the first place.Surely this in itself,by not turning up, they cannot take to an upper tier tribunal as they had their chance to challenge at the first tier tribunal. This whole Dwp process of paying back enititled monies and setting their records straight is somewhat suspect...If people owe the dwp money then they seem to send letters out at the speed of light and adjust their benefits(sometimes without notifaction). As for the manager taking another 11 days???We will give them that, but any further delay may result in our Member of Parliment getting involved...after all we elect them to help the electorate when its needed most. But I suppose that the Dwp are short staffed and that will be their excuse.

Hi
The DWP normally take 5-8 weeks to begin payment following a tribunal decision. The only way they can challenge the decision is on an error of law.
It is becoming more common for the DWP to request a SOR from the judge, but this is not usually anything to worry about.
The good thing is that they have received the decision from the tribunal, which suprisingly often gets mislaid
