    Hi I recently received a migration letter asking me to claim Universal Credit having been in the ESA support Group for numerous reasons including loss of oxygen at birth since 2013.

    I have since been turned down for universal credit due to my capital and i have been ignored regarding the capital disregard,it seems also i probably do not have enough national insurance credits having not worked probably in 15 years or more. I have a lot of capital due to gifts from my Dad birthdays,xmas monetries and with effectively having the minimum wage with no transport to work too and rent paid for my money has accumulated.

    Now my savings are expected to pay for all this which was gifts not paying for a roof over my head.

    Do I have any hope of appeal or any other way to get income? I was put in support group via my MP in Eastbourne and classed as vulnerable and unfit for work.

    What is your total capital amount, and what amount do you feel should be disregarded, with reasons please?

    I have about 18 thousand and this has come from income from my Dad for gifts and distance i have not seen him since 2007 a lot of hurt in the family. The rest of my money is from benefits in that 18 grand that i have not spent due to limited access to eating out. I have OCD and like i say numerous reasons i was placed in this group

    I just think my money from my Dad should not be a reason to say i am not eligble for not being fit for wotk to have my money stopped because of universal credit. I was sanctioned back in the day for being considered not looking for work and i was. My Mp acted on my medical records and i went through a work capability assessment that got me in support group old style esa. I probably cannot qualify for new style contribution based esa as well as universal credit

    Any capital over £16k means you have no entitlement to Universal Credit.

    UC is means tested so you would be expected to live off your money rather than the welfare state providing you with more.

    There are disregards with capital under UC but nothing in the information you've given suggests any of your money qualifies.

    I agree that you would not qualify for New Style ESA.

    If your capital drops below £16k in a reasonable manner (ie no unusual spending with the intent to claim benefits, namely Deprevation of Capital) then you can re apply for UC. This would be treated as a new claim and you'd have to undergo a work capability assessment.

    Old style ESA also had the same capital rules (under £6k no effect, £6-£16k reduced entitlement, £16k+ no entitlement) did you ever inform them as your capital increased?

    No I just accepted each month the money they said i was entitled to. I had no idea about gifts from my Dad could have had an impact. My money accumulated like i say really from spending anxiety too.

    It was many years ago i was put in support group. With no income now i am open to trying to get a job who knows i may hold it down im not the troubled young man i was many years ago and im now 57,also cannot get sanctioned now if im getting nothing? I was judged as not trying to get a job and this was not the case i just had a really bad work record from a young man due to medical history and anger at so many things so i did not get employed in the end. I was definately eligible and it was right i was put in support group. I wonder if i can somehow get work?
