Hi @emma85, At the moment we don't have all the details as nothing has been confirmed. The last I saw was that they are now considering in more detail how people over state pension age will be affected by the 4 point rule:

Written questions and answers - Written questions, answers and statements - UK Parliament

I'm afraid I don't have any more solid information at the moment, but I hope we'll learn more soon.

There is a line in the bill which looks like people over pension age may be excluded from the 4 point rule.

SSo They might not be affected?

Subsection 4 appears to be a "get-out clause" to allow the SoS to make special provisions for particular groups of people.  They almost certainly have pension age PIP claimants in mind here.  The paragraph actually says:

"to make different provision for different cases or purposes (including different provision for persons of different ages);"

So, for example, it might allow the SoS to decide that the 4-point rule will never apply to any person at or over pension age, who is already in receipt of PIP daily living in November 2026.   This would give pension age claimants an exemption, but it's interesting that this is not being put into the Act itself.

The subsection also allows the secretary of state to provide for "a person to exercise discretion in dealing with any matter".

@emma85 They might not be affected. It all depends on the interpretation of what @bellatango has pointed out. Not worded in the bill very well.

Stephen Timms is a disgrace, He was having a meeting with some disabled activist and one collapsed on the floor, he just got up ,walked around her and left the room. He shouldn't be disabled minister. Richard Burgon has been campaigning against these cuts, he would be better

Hi @emma85, unfortunately, we still don't have many facts about this. When the bill came out a couple of days ago it included a part about age which bellatango was talking about a few posts up. That may mean that people of pension age aren't affected by the PIP 4 point rule, but there still hasn't been any official confirmation of this yet.

I understand. But it's not very fair on the people that needs the money to live on to help them on a day to day basis

Do you have a source for that? I see nothing except he has angered disabled campaigners by making 'insensitive' remarks.

This bill is going through, it's just a question of how it is amended.
