Bad news for existing PIP claimants ?

The concession that existing PIP recipients wont be subject to new PIP rules was obviously dropped along with the proposed 4 point rule, but for existing claimants that could be bad news. The Government have said they are going to change the PIP descriptors, points etc and just because they have agreed to 'consult' doesn't mean there wont still be major changes, ultimately they can do what they want, they will make the final decision, but the worst bit is they can now make those changes to PIP WITHOUT bringing it back to be voted on by MP's and therefore it's possible that any changes COULD now apply to existing claimants and MP's wont even get a chance to object !!

I don't think half the MP's who voted in favour tonight understand it either, by removing the 4 point rule at the last min it's left the door open to future PIP changes (following consultation) can now be made without the need for MP's to vote on it

I wouldn't worry about it, regardless of what is voted through or not, people will still have a rough time with the current system. How many have lost their PIP at their reviews, who were on Enhanced both elements and having to fight to get it back currently! Just this week a family acquaintance told us his son lost his PIP (Enhanced both elements) and a parent the Carers element. A member of this forum lost hers too. It's happening all the time and has in the past. It is Reeves I don't trust, we'll have to see how it pans out.

It’s a good thing they are getting another opportunity to vote next Wednesday, when the bill receives its third reading before moving to the Lords. Many speakers in parliament warned today that if real clarity isn’t written into the bill next week, they will vote against next week.

Pip now will be left alone as MPs are fighting there corner for them and they have worked out that we are the people who are vulnerable

As someone who's PIP Review form has landed on a DWP desk today (already had an anxiety dream pulling my own teeth out) I am already dreading any changes,(I'm Enhanced on DL & Mobility) They say PIP is safe from any changes but tbh there's nothing to stop DWP applying the 4 point rule to anyone in the review stage atm,we would be non the wiser,on how they distribute points now or in the future .

Is there a clause at the moment to make sure that The DWP by law CANNOT apply any future points changes to those already going through review? I can't be the only one thinking this,my MH has already tanked thanks to recently going through ESA to UC migration,then the DWP throw my PIP review at me,when I'm already at a low ebb.

Sorry I needed to vent,as I've got no one to talk to regarding these changes .

The DWP have a guide that must be used in their scoring. You can see this on the Government website - PIP assessment guide part 2: the assessment criteria - GOV.UK. I'm no legal expert, but I'd expect this could be utilised alongside any other PIP documentation of the individuals by their solicitor if they were to formalise a complaint.

Thanks for that info @Holly_Scope,it's eased my overactive mind ,I'll read that link ,I think it's just that many if not all of us think that the DWP will do EVERYTHING in their power not to reward PIP,and considering many Mandatory Reconsiderations are overturned ,you can see the reasoning behind the thought,honestly though thank you so much for your reply 😊

Hi @emmadm101 - please rest assured that the clause in the Gov'ts UC & PIP Bill about the additional proposed 4 points needed in at least one activity has been totally removed. So, currently, how PIP is assessed is just the same as before. There will be a review about the PIP descriptors, but, if anything changes, it won't be until Autumn 2026.

The link that Holly has provided is the best you'll find as it's about what the assessors are looking for as regards PIP. Please, if nothing else, read the section about 'reliability,' as this is so important.

The proposed 4 point rule is completely gone, & won't come back! Hoping your review goes well.

Hi @emmadm101 I can completely understand your thinking and I'm sure you're not alone but I'm glad that's reassured you. I think the main area we need to keep an eye on is this welfare reform bill as this will be where any changes are going to be legalised. The U-turn has been really powerful progress for us, and we've now got a lot more eyes on what they're thinking about implementing but at least for the most part, they've ceased a lot pending this Timms review and promised to do this in conjunction with disabled people. We've a long way to go, but we've made some real progress.

Thanks for your reply ,it's just such a worry ,especially with the DWP putting me through migration last month and now throwing a early surprise PIP rewiew at me this month ,just feel like I've got no breathing space ,like everything is being chucked at me,thank you for your good wishes regarding my review 😊
