PLEASE HELP - Paid a CIC to help me with tribunal, how much should I be paying them back?

Hi all please help 🙏

I had a motorbility car & my motorbility element of PIP was stopped back in Aug 24 I was allowed to keep the car whilst I appealed & MR took place on the understanding if PIP was reinstated I had to pay back any outstanding amounts.
I had to go to tribunal so car was taken off me 18th December 24 I paid a CIC Company to help me fill out forms for appeal / MR / Tribunal £25 each time & agreed to pay an additional 25% fee on top from any money awarded to me.
Total amount was
£3117.45
Amount due back to motorbility as agreed
£1282.55
Balance
£1834.90
Do I pay 25% of £3117.45 or 25% of £1834.90

    Hey @Angel9xs as said yesterday, they should tell you what the end amount to pay is, so i'd not worry too much about this. Though I think it will depend if they're using total money awarded, or total money awarded after other payments have been taken. This should be in the terms and conditions for the CIC company.

    Personally, I'd be prepared to pay 25% of the total awarded. Should the company request less, then that would be bonus!

    As @Albus_Scope says, your paperwork should clarify this for you.

    X% contribution from any award received in benefit.

    Prior to Tribunal I did explain I had a duty to pay Motorbility back so contribution wouldn't be a lot but at no point was it explained I had to pay prior to paying Motorbility,

    Sorry @Albus_Scope I was online so I did the calculations.

    @Angel9xs looking at your full thread:-

    You lost your PIP Mobility element in August 2024

    I gather you have won your tribunal case and the back pay is £3117.45

    You had your Motability car for four months extra while you went through a MR, so you owe £1282.55

    Remaining funds = £1834.90

    Right, reading all your additional information which you have attached:-

    1. You pay back Motability what you owe, which is £1282.55 - You do this first (priority)
    2. You then pay the charity 25% of the remaining funds, which is 25% of £1834.90 = £458.73
    3. You are left with £1376.17

    Therefore according to your attached information you only pay the Charity 25% of £1834.90 which is £458.17

    I am not an ex school teacher, but thought it better to explain it all this way. Hope it helps!
