Hi frontier53, no problem at all you jumping on here.
I have to migrate by 30th Aug and I'm still not sure what to do, like you say there isn't much information.
It means I/we would be £21.20 a week worse off basically (the disability income guarantee) which I can cope with but I just don't know if I would be shooting myself in the foot. My ongoing award for enhanced pip lasts until 2029.
I can't actually remember the last time I had a face to face assessment. I was on IB for about 7 years and then it was changed to ESA. I did go to an assessment for ESA in 2013 I think and the lady was running about 2hrs behind, she came out to me in the waiting room and could see I was clearly in pain and said something along the lines of "oh you should never have been called back in" and cancelled it and told me to go home and I've never heard from them since.
My concern is what happens to CB ESA in a few years time and this new unemployment insurance that will be time limited?

I did see this on benefits and work site. On there they say
Yes, your husband would still receive his Contributions Based ESA.
As you would be ignoring UC migration his Conts Based ESA would not be converted to New Style ESA.
I thought it would convert, so what does happen then?

Many thanks, @bellatango. I actually have to migrate by early August so I'll be ahead of you in that case. I'm pretty determined I'm not going to claim UC as I know I'll find the process too stressful. My last encounters with the DWP left me with PTSD as it was so bad (involved demands to attend work assessments the day after major surgery, MP involved, the works, never again). I do wonder if I might have to remind the DWP that I'm still entitled to Contributions based ESA (P60U confirms that) once the income based element goes. I don't want to phone them as I know I'll be on hold for hours and then just end up speaking to someone reading from a script. So I might write them a recorded delivery letter. Many thanks for your reply and the post from Benefits and Work, I'd missed that. It is odd there's no information online on forums as surely someone other than us must have gone down this road already. I've seen how making UC claims have destroyed people and I just can't do that, would rather just get by on slightly less. Anyway, thanks again, perhaps some more answers will come to light in the coming weeks. 🙏

Is anyone else in this situation? CBesa with IR top up.
Would ignoring the migration letter just result in esa converting to ns esa (so £281.10 a fortnight) and just be left alone until this unemployment benefit insurance starts if it happens? I would rather be £20 a week worse off and not have universal credit breathing down my neck.

I'm going to be speaking to a benefits advisor tomorrow so will see what he says. I don't see how the DWP can just stop the contributions based portion of our ESA when it's specifically income related ESA that's going. And the fact I receive a annual P60U with an actual amount of taxable benefit (as opposed to 0) listed makes it pretty clear I've been receiving the contributions based ESA with income related top up that so many other people have been receiving. But I wonder if I'm going to have to point this out to the DWP. I'm more determined than ever that I'm not claiming UC. My mental health is slowly getting better so it would be totally counterproductive to go through the DWP nightmare again.

I don't know if we can you just ignore the letter and not do anything, then it converts to ns esa or what. I'm pretty certain we are both on a mixed award as I receive the disability income guarantee and like you a p60u every year. Plus I get enhanced for both parts of pip til 2029.
If that's definitely the case then I won't be migrating either. The only thing that concerns me is this new time limited unemployment insurance that's due to start 2028/2029 but we don't know enough about that.

CB ESA will not convert if you lose IR ESA but don't migrate to UC.
You should just continue to get CB ESA. But expect to be hounded by the JC with more letters and phone calls if you don't respond to the migration letter. (This is done to keep vulnerable people safe, but not ideal for anxiety sufferers).
Currently there is no protocol for replacing CB ESA with NS ESA, unless you migrate to UC. Obviously we don't know exactly what will happen to CB ESA in future.

Ah right I understand now.
So at the moment (even though the letters never say it) my award is CB esa with an IR top up and in the support group.
If i migrate that changes to ns esa (fortnightly) and uc monthly with the ns esa deducted.
So if I don't migrate then the award just stays as CB esa but lose the IR top up as that would end, losing the disability income guarantee of £21.20 a week.
So if I wanted to do the latter (not migrate) who is best to call ESA or UC and would I have to explain why?

Yes, that all sounds correct.
I believe CB ESA is £281.10 a fortnight now, same as NS ESA. So you might have more of an IR top-up than just the disability income guarantee (also known as EDP).
You should call ESA to tell them you don't want to migrate. UC won't have your information until you submit a UC claim. ESA may direct you another DWP department.0
