pip questions

Hi, hope someone can help, both my mum and brother had there telephone assessment but my mum had her about a week before my brother did but he has now had his decision and he got the lower rate on both but my mum still has not had her decision, does this mean she has not passed.
Also I hope someone can help with this one too, my mum is due to retire in January and if she appeals the decision after she does the mandatory consideration, will it still go through because I no you can not make a new claim have you retire but does this count if she already put in her appeal before her retirement date.

Unfortunately some claims take longer than others. It’s quite normal for decisions to come through at different times, even if two people had their telephone assessments close together. The DWP doesn’t always process them in order, so the fact your mum hasn’t had her decision yet doesn’t mean she has been declined, it just means hers is still being looked at. I hope she hears soon as I know the waiting can be difficult.
For your second question: if your mum gets her decision before she retires and she asks for a mandatory reconsideration, or later goes on to appeal, this can still go ahead after her retirement date. You can’t start a brand-new claim for PIP then, but if the claim was started before she reached retirement age, she can carry on with the MR and appeal process as her start date is before then.

Think my mum thinks because she had her assessment first and my brother had his a week later but she still not heard anything and my brother been awarded his, she thinks she not getting it now, but I told her it could just be that her case got push down the list and my brother got put on top or because his was a shorter assessment because most of his was a paper base assessment because most of his was for mental health issues and they got a lot of information from his GP and mental health provider, where my mum's is more about mobility issues has she has severe arthritis so her may take a bit longer.
Thanks for information on the appeal part, if she does not get awarded anything she definitely going to appeal it.

Update, my mum did not get the points needed, not sure how. My brother got his but my mum did not and I would say her situation is worse, has she has to use a walking stick everywhere she goes, or has to get a taxi most of the time because she can not walk that far. She can not use her hands to open stuff or cut stuff up, she does not cook because of this reason, she has to have help washing her hair etc and struggling getting up off the chairs etc and this is every day. where my brother and a couple other people I know who get pip do not have this issue. I not saying they should not be on it but just saying that my mum should have passed too. It seems very unfair. She not sure if she should do a mandatory reconsideration or make a new claim has it his quick.
Also not sure if anyone can help, I also have applied for Pip but mine as gone to appeals court but I forgot to put some of my other issues on, can I make a new claim or will this wipe out my claim I have already made or can I just say this stuff when I go to the appeal court.

Thank you for the update.
It may be easier for your mum to request a mandatory reconsideration as it can keep the original date and is usually faster whereas if you start a new claim you are going back to the beginning, hope that makes sense!You can explain the other issues at your hearing or send them in now as extra evidence but it’s best not to start a new claim yet as that might cancel your appeal😊

My mum said she will ring them up tomorrow and make a decision when she speaks to them. Just annoying has she telling that she can not cut food up and someone has to do it for her but they keep put that she can cut food up and this is where she misses out because she getting 6 points but they keep putting she can use a knife when she told them multiple times that she can not and needs help to cut food up. Sorry it just Ridiculous

Update - My mum did her mandatory reconsideration but it failed too. She rang up this morning and they said that they received the mandatory reconsideration on the 4/9/25 and they made the decision on the 5/9/25 sorry I think that is a bit quick especially that we sent evidence that proved that the original decision had inconsistencies like they said there was no evidence on her medical records that my mum has something wrong with her hands but she spoke to her GP and she said that was not true and pull up the records and showed that it is on her medical records that she has arthritis in her hands and it dates back to 2018 so we send this and other evidence but still no. So it is truly believable that the mandatory reconsideration is pointless and just wasted tax payers money on the part of PIP, has they never overrule the original decision. It should just go straight to appeal instead and this would be quicker and cost less.
Does anyone no the estimates time it is taking to get the appeals tribunal. Thanks

Heya @jo1984 sorry to hear your mum didnt have any luck with the MR. I always suggest you focus just on the actual descriptors and where points should be awarded, not about what the assessors said or didn't say. It's worth noting this for the tribunal.
I can't give a firm estimate unfortunately, as it all depends on how busy the courts are in your area. But you could be looking at a wait of several months.0 -
It was PIP DWP that said there was no evidence. And we did, we agreed on a couple of things and we put that and we said she should have been awarded 2 points of food and drink as my mum needs someone to cut her food up because she can no longer do this and we put it in the original form, to the person she spoke to and put it in the mandatory reconsideration but still did not receive the 2 points so disappointed.
Ok thanks we are going to appeal just hoping it does not take to long.
I appeal mine at the beginning of January 2025 and I still waiting. Give to January 2026 and it will be 2 yrs since I begin my PIP claim, sorry I think that is a bit ridiculous.
