Mandatory reconsideration and appeal advice

I've just had my telephone assessment and received a copy of my report. After going through the report it appears that I've received 14 points for daily living but zero points for mobility. I'm quite surprised by this because I was more leaning towards me getting mobility because of my severe anxiety. I very rarely go out only to the doctors which I've been visiting for 40 years and it's only five minutes walk from my home. And it seems that the assessor wanted to dwell on this because I mentioned that When my wife was unable to go with me I would go by myself and that I take I would take my Xanax before I go and this allows me to be able to cope this seems to have gone against me. I've spoken to my Consultant Psychiatrist and she said that that should not have happened because Xanax should be taken as a last resort because it's highly addictive. And she does not recommend me having to take it every time I need to go out of the house and she of is of the opinion that this should not have gone against me in my pip assessment. My concern is this if I ask for a mandatory reconsideration or eventually an appeal I've been told I run the risk of losing my 14 points for daily living is this true please advise.

Yes that is true unfortunately. You can ask for a mandatory consideration if you're not happy with the outcome but you do run the risk of losing your 14 points for daily living as they will look at the whole award again not just the mobility component0 -
So am I to understand that if you put a mandatory consideration you will get no payments for the daily living component while they're looking at the mandatory consideration even though it's been awarded.

Hey there @cldcp00 Whilst the MR is being dealt with, you'll still receive the current award. So in your case you'll continue to receive the recently awarded daily living component up until they decide which way the MR will go.

So what is the consensus as to going for a mandatory reconsideration I truly don't want to lose what I've been awarded but still feel that I should have got the mobility part what are the odds of me having my daily living component totally removed and ending up with nothing

The Scope representatives have given good advice. You are on the Enhanced Rate Daily Living. That is more money than Standard Daily Living + Standard Mobility. My thoughts are that Mandatory Reconsiderations rarely change the original decision, so you could have to Appeal which could take a year. You would still get your current award money. But lets say you got Standard Mobility after all that hassle, it's only £29 a week.... I understand you struggle to go out, but you have stated to the assessor/DWP that you can walk to the Doctors Surgery that takes 5 minutes. I agree Xanax is addictive, like Valium, but you have stated you can manage. It is up to you, but I am thinking if you would be successful with your claim with the information the DWP already have. It is a hard one, and as stated by the Scope representatives, your whole claim will be looked at again... Enhanced Daily Living is a good result! You asked for thoughts from forum members, this is what I think. Obviously, it is down to you! Hope this helps you.

I think you have done right. You can always ask a benefits advisor if you know one to see what they think too.
