in PIP, DLA, and AA
I just received my pip decision today and have been awarded enhanced rate care but nothing for mobility when i read the information from the assessor i could not believe the blatant lies she had put, what do i do?

    Is it the decision letter you have or the assessment report as well ?
    If you feel that you fit the criteria for the mobility element then the first step is to ask for a mandatory reconsideration. There is plenty of info on this site and the CAB site about MR's and appeals, which are separate things, the MR has to come first.

    Hi cockney rebel yes the letter had a report with it, i am so angry at her lies and things she ommitted like i have background diabetic retinopathy and also diabetic neuropathy, im worried about asking for reconsideration as they told me they would have to reconsider my care award, i cant understand why i got 0 points for mobility when i have been told i need both hips and left knee replacing but due to my age i have to wait plus arthritis of my right ankle thr assessor put it dien as a lower limb problem... just worried about what will happen if i adk for the reconsideration

    Hi Tess

    How many points did you score for the care component ?
    How long is your award for ?

    It is not unusual for the assessors report to be different to how we see things. At this stage there is no point getting angry about it as that will not score you the points you need.
    It is true that an MR will look at your whole award and can reduce the points you have or even take it away, but that does not happen to often.
    Mobility awards are given in two parts, planning and following journeys and moving around.
    From what you say your problem is with moving around so how far can you stand and then move either aided or un aided ?

    12 a. Can stand and then move more than 200 metres, either aided or unaided. 0 points
    12 b. Can stand and then move more than 50 metres but no more than 200 metres, either aided or unaided. 4 points
    12 c. Can stand and then move unaided more than 20 metres but no more than 50 metres. 8 points
    12 d. Can stand and then move using an aid or appliance more than 20 metres but no more than 50 metres. 10 points
    12 e. Can stand and then move more than 1 metre but no more than 20 metres, either aided or unaided. 12 points
    12 f. Cannot, either aided or unaided, �(i) stand; or (ii) move more than 1 metre. 12 points

    You need to score 8 points for a standard award and 12 for enhanced

    For the care component i received 15 points and i can stand using the aid of a crutch but i cannot walk 50 metres as i need to stop every cpl of metres due to pain and also breathlessness as i also have 2 cardiac conditions and it has been awarded for 4 years. Thank you

    So you have a 3 point buffer on your care component and it sounds as though you should meet the criteria for at least standard mobility.
    If you walk 50 metres once, can you then repeat this or would you need a long rest ?
    if this is the case you may not fit 12d but may fit 12 e

    How long does it take you to walk 50 metres ? if it takes you twice as long as an able bodied person ie longer than a minute, again you may fit 12 e

    MR's don't have a good success rate so be prepared to take your claim to the tribunal where you should get a fair hearing

    ( lastly, I don't wish to be indelicate but you mentioned your age affecting your operations but ............ )

    Its what my GP told me, you have to be over 60 to have the replacements.

    My wife had her first hip replacement at 48 so I guess it is down to postcode lottery.

    Please let us know what you decide to do but bear in mind that the clock is ticking one month from date of letter including posting to them. or you can request by phone.
    Did you supply a letter of support from your GP ?
    Your GP must know about your limitations with mobility, a letter that is very specific to the PIP mobility desciptor will definately help, if not at MR then at appeal

    Thank you and yes in Manchester they will not operate until 60 or over i am at My Gps on Weds so will take the letter to him to see ehat assessor put. Thank you
