Motability are taking my car

Hi. Motability are taking back my car. Claiming misuse. It has a tracker to show its not misused. Its my lifeline. Im 67 I have no one close only my daughter and son in law. They are 20 min away in a car and £5 fuel. Public transport is 1 bus 25 min, 1 train 30 min, and only 1 train an hour. What can I do? Motability wont listen? Its going to make me miserable and lonely and cut me off. Im a paranoid schizophrenic and believe people call me names. I do not trust anyone. We think someone may have lied out of jelousy. Please please please i need my car. I dont drive my daughter does everything. Please help me.

    Your family members who have been accused of misusing the vehicle could approach their MP (and your MP if different to theirs).

    If there has been an error made by Motability, and they are ignoring your evidence the car has not been misused, Motability will find the error quickly once a MP is involved.

    Hi,

    Is the car kept at their address rather than yours? If so, maybe they are using it for personal reasons which would be considered misuse by Motability. The car is only to be used for your benefit.

    The car is at there adress. However they do everything for me. The car is not used much, I stay with them often. 95% usage is for me.

    In that case, 5% of the usage is misuse, and Motability are correct.

    Oh dear. The car is only used for me. My daughter does everything for me. The only things that are not for me, are done on route to me, or whilst getting stuff for me. Should I have to suffer as a 67 year old immobile paranoid schizophrenic who has been entitled to a car for years and only just decided to get one. My life will be lonely and difficult. There are many people abusing motability. We are not. Good day.

    Hi @Toni3008. You can contact Motability on 0300 456 4566 or use their online form to discuss it with them. Have they explained exactly why they think the car has been misused? I'm sorry you're having to go through this.

    Your motability car can only be used whilst your in the vehicle, otherwise it's classed as mis-use. Also having the car kept at a different address is also mis-use. You can try to appeal the decision with motability however if they still claim mis-use and take the car back, theres little you can do at that point.

    That's not strictly true. The car can be used for picking up prescriptions or groceries without the disabled person in it. However, every single trip must be for the benefit of the disabled person.

    If the car is used for a personal journey, then Motability insurance does not cover it, which means the person is driving illegally, and the car would not be insured if it was involved in an accident during the these circumstances.

    This is what they list as examples, so this is not an exhaustive list:

    1. Not using the vehicle for the disabled person’s benefit. It needs to primarily serve the needs of the disabled person. You cannot use it for other purposes
    2. Driving while not named on the Direct Line Motability policy of insurance, or while banned or disqualified from driving
    3. Using the car in illegal or criminal activities
    4. Lending, or selling the vehicle. This includes using it for business reasons we haven't agreed with you, like as a taxi or for deliveries
    5. Not taking good care of the vehicle

    Hi Rachel. They said it was being used for the school run. Yet they said it was during the school holidays. I'm not allowed my granddaughter due to my mentally illness, when I stay at my daughters I would ask to go in my car in a morning part way. My son in law and granddaughter would go the 10 min further on foot, and me and my daughter would walk to the park or back to get my daily exercise, and help me feel like a normal grandparent. Motability said this is not beneficial to me. I want to be like other grandma's, I'd enjoy it. My life was improved so much. My daughter and son in law drove me places for years in there own cars. I could have got Motability years ago. They gave me my independence and ability to see my family and its now being cruelly taken. I'm the victim in all this. Motability won't listen to reason. They send they would send a letter to show evidence. They have not. I don't read texts luckily my daughter saw a message giving a date to return the car. They never sent a letter or emailed. I don't answer to numbers I don't know. It's just a mess.

    How long has it been since they said they would send a letter of evidence? I'm not familiar with this process and how they make decisions but I really hope this can be resolved.

    I am very sorry you are facing this. It is clearly distressing for you. If the car is not kept at your home address, the tracker was likely installed to monitor usage. That data should be central to any decision Motability makes.

    The tracker will show exactly where the car started and stopped, how far it travelled, how long it was stationary, and, crucially, the exact dates and times of each journey. If the journeys were short, local, and consistently stopped short of certain destinations, that supports your case.

    You can submit a formal written complaint asking Motability to pause the return process while the facts are reviewed. They may not agree, but you are entitled to make that request, especially if the decision was made without reviewing tracker data or providing written evidence. If they refuse, ask for written confirmation that they are proceeding without reviewing the tracker. That omission alone may justify escalation.

    You deserve a process that is fair, transparent, and grounded in evidence. From what you have described, it does not feel like that is happening.

    Thankyou everyone. I know people take advantage and misuse mobility cars. This is not the case. Iv been given a life again. Ill keep you all posted. My daughter has spoken to the fos, and also rang motability. How do we fight it if we arnt shown the evidence? The ladies she spoke to today were really helpful. People forget what good mobility cars can do for people. They are busy trying to catch people out, while the people who benefit are not always taken into consideration. Thanks guys

    I have a son. He lives 3 min away. Yet my daughter and son in law who are 11 miles away are the ones that answer my calls, take me to stay with them. I see my granddaughter. A son is a son till he gets a wife. A daughter a daughter for the rest of your life. If my son was the driver there wouldn't be a tracker as he lives close. The thing is he wouldn't do all my daughter does.
