hi I really need some help with my mandatory reconsideration.

I was previously awarded 12 points on the mobility part but on my review I was reduced to 10 points.

I need help on how to put into words my response to challenge this I have severe anxiety and depression and only leave the house for my regular hospital check ups for my other illnesses and for gp,dentist appointments and to pick my son up twice a week from his mothers all of these I need someone to travel with me in the car due to having panic attacks on my own and been so overwhelmed that I get lost and need to abandon the car as I feel like I can’t breathe and I am choking.

can someone please help me put this into the correct words to answer the question.

Hi @rossco2511 has the reduction in points meant that you are going to receive a lower award? If not, I would leave it as going through a mandatory reconsideration is stressful and it wouldn't be of any benefit to you.

If your award will be lower then you can get support in filling in your form from these places:

    Find an adviser (Advicelocal)

Find a local benefits adviser (Turn2us)

Is there a family member or friend that could help you too?

hi yes I currently receive 12 points for mobility and have my mobility car and now it’s been reduced to 10 points I would be unable to attend my hospital and doctors appointments or leave the house without the 12 points as I need someone to come with me to all of these appointments which is usually my daughter who is 21 but doesn’t drive or my next mother who also doesn’t drive.

but I immediately someone to encourage me to make the journeys and guide me to the destination as I get overwhelmed and have panic attacks on my own.

Ah I see. To be honest you've described how badly it affects you really well in your original post! Going by the indicators I've copied below, you've said that you need someone with you at all times, even on familiar journeys.

    1. Cannot undertake any journey because it would cause overwhelming psychological distress to the claimant. 10 points.
    2. Cannot follow the route of a familiar journey without another person, an assistance dog or an orientation aid. 12 points.

I think what you've already written is good. Maybe our members might have some different advice or you could contact the links I provided above if you're not sure.

Sorry but it sounds like they have awarded correctly.

If you are unable to go out at all on more than 50% of days then the 10 points descriptors is correct.

12 points is for people who can go out on more than 50% of days.

but that doesn’t have anything to do with following a route of an familiar journey.

they gave me 12 points last time for the same answers

Rachel has given great advice, these organisations will help you with writing your Mandatory Reconsideration (MR). You need to let the DWP know why you need the two points you have lost. From your previous thread, you forgot to mention certain points which you need to mention in this MR. Let the DWP know you cannot manage to go anywhere in your motability car without your daughter or neighbour accompanying you and tell them why. You could get your daughter and neighbour to back this up with their own letters too. Go into detail about how your disabilities affect your day to day. Best of luck with the MR.

Some assessors get it wrong. There are a few members on here who have been overscored for this.

The 10 points descriptor over-rides the 12 points descriptor. Basically it does not matter if you need another person with you if you cannot go out for more than 50% of days. By saying that you only go out for appointments and twice a week to pick up your son means you cannot score 12 points for this.

(I am well aware of the rules, because I fall in the same place, unable to access Motability).

You can appeal this of course, but you will need to prove that you can go out on more than 50% of days with another person.

thanks @Overlyanxious it would actual be 4 days a week as I pick my son up on Wednesday from school and drop him back at the school on a Thursday then I pick him up Friday then drop him back at school on the Monday each time having someone with me either my daughter, mother or friend who is my long term neighbour would that help in anyway.

Then that is what you need to make clear to the PIP assessors. More than 50% of days. 🙂

I also answered question 12. Moving around

With in can only walk between 20 and 50 metres due to my chronic abdominal pain and back pain but of forgot to mention it was because of the pain in my back and abdomen and instead answered only mentioning the distance was this far due to my severe anxiety

    Yes, that's another problem there.

The moving around question is only interested in physical limitations. Mental limitations were covered in the journey question.

So you will need to make sure you only include the physical issues in question 12 for the Mandatory Reconsideration. (Although this will not matter if you can score 12 points in question 11).
