Title: URGENT: LCWRA Backdating to March 2022 – Official Error & System Failures

Message:
Hi everyone,

I am looking for urgent advice on a backdating case for Universal Credit. I have ADHD and Autism, and the DWP’s handling of my case has caused me extreme stress and "rage-baiting" over the last month.

The Situation:
I have recently "discovered" that I have had LCWRA status on my file since March 2nd, 2022. This came to light this month (March 2025) after my clinical prescriber suggested I should be on it. When I checked with a DWP agent on the phone, he confirmed that the 2022 date is indeed on my record from a previous ESA Support Group claim.

The Recent Failures (March 2025):

  1. The Sick Note Trap: This month, the Journal staff repeatedly told me I must upload fit notes. I got the notes, but their system physically would not let me upload them.
  2. System Admission: A DWP agent on the phone tried to upload them for me and admitted the system was blocked. He then told me I don't even need fit notes because of my 2022 status.
  3. Conflicting Advice: Despite this, they referred me for a new assessment on March 9th. I filled out the UC50 forms and sent them back, only for a representative today to confirm again that I do not need to fill out forms.

My Goal:
The DWP has ignored my requests to backdate this to March 2022. Based on my calculations, the arrears owed (the LCWRA element) is approximately £19,000, which is vital for my housing security (the HOLD scheme).

Questions for the experts:

  1. Since the DWP agent admitted the 2022 date is on my file, how do I force them to pay the arrears under Official Error rules?
  2. Does the fact that their system blocked my fit note uploads this month count as further evidence of an Official Error?
  3. What specific wording should I use in my Mandatory Reconsideration to ensure they don't try to "start" my claim from March 2025 instead of March 2022?

I am being moved from pillar to post and ignored on my Journal. Any help with the legal regulations to quote would be a lifesaver.

Hi @EzeeEzee and welcome to the community. I'm so sorry for the issues that you're experiencing, it sounds very frustrating. Unfortunately, we are not experts and are unable to give legal advice. Have you considered speaking to a solicitor? The Ombudsman may also be able to help you if you've already lodged a formal complaint with DWP https://www.ombudsman.org.uk/

Are you saying that since 2022 LCWRA element has not been listed on your monthly payment statements?

yes correct I was trying to apply for LCWA they kept trying to make me send sick notes and then after some investigation I found out via the phone that I’ve had LCWA on my claim since May 2 202 meaning that they should’ve been paying me since then

As this seems to be quite a complex problem I would recommend speaking to a trained benefits advisor locally
