Hi, my name is KAndrea! Struggling with MS and PIP refusal

I have ms and it’s getting worse. I appealed my first pip refusal and don’t know where to go next.

Ms nurse is being difficult sending me evidence and I have no one to write things.
I used a charity who gave all the I can wright it for you but he never added all I needed to say. The pip. Ever even contacted my gp, ms nurse

I want to Just quit work which I’ll have to once they take the car… it was give. To me indefinite with DWP but now with pip it’s taken.

My mobility is worse and me looking after myself I cannot do.

Because I can speak, understand my day nav I use just 3 days a week to work only I’m not entitled.

I can’t wash my hair, m as he any food, walk right and in constant ms pain.


they say because I swallow tablets I get no points but my hubby has to watch me take them. Prepare them it’s not fair

I can’t live like this anymore

    I have new spasms I hate work but cannot stop as I don’t get lots.

    I need someone who cares and understands.

    I can’t bd stressed my ms gets worse, im depressed and my life is useless.
    I don’t want to die but what more can I do for them to take me seriously and accept my ms has taken everything

    Hi @KAndrea and welcome to the community. I'm so sorry that you're going through this. Can I ask, was it a Mandatory Reconsideration that you went through for your PIP? Are you planning on going to tribunal? I can speak from personal experience as my mum has MS and had to go to tribunal to be awarded. She also has issues with her MS nurse and has done for many years, I'm sorry you're experiencing the same thing. She's also just retired on Ill Health grounds so I'm happy to find out more about her experience with that if you'd like?

    Have you looked at the MS Society? They have lots of useful information and support. They even have a forum that could be good for you to talk to others in the same situation - MS Society Forum.

    I've sent you an email so on the lookout for that.

    Ugh, DWP is staffed by complete fools, so many MRs, why don't they just grant the benefits in the first place then they wouldn't have to faff about with tribunals every time?!

    well now I’m having to get a tribunal which I believe I need to call to object and start it??

    it could take a year or so I’m told.
    my ms nurse is useless as well as the neurologist I only seen twice in five years. Been given info from another ms sufferer who said to get my doctor to refer me to another county neurologist which is only 20min away.
    but my doctor s hard to get a message too. Tried nhs site but cannot get just a simple answer to just send a message!

    Gp closed until 2pm but all the options to press are not to give gp a message.

    And appointment isn’t until mid May

    I need to tell DWP about this within a month.

    Hi @KAndrea. I'd definitely try to get referred to a different neurologist, you shouldn't have to suffer with the one you've currently got. Could you speak to the GP receptionist and ask them to pass on a message? You might just have to choose a 'wrong' option to get through.

    Here's the link to start the tribunal process https://www.gov.uk/appeal-benefit-decision/submit-appeal . I would still go to tribunal and hopefully you'll be able to get the extra evidence in the meantime to send to them.

    Do I need someone to come with me like a solicitor. And do I need to write a statement on what the mandatory appeal wrote which was wrong?

    All of the above, and I know they won't do anything but you should strongly consider making a formal complaint to the DWP about your treatment.

    You can take a solicitor but it isn't necessary. There's some information here about who you could have as a representative as a solicitor may be expensive and also more information about how to apply to a tribunal https://www.citizensadvice.org.uk/benefits/sick-or-disabled-people-and-carers/pip/appeals/apply-to-tribunal/

    You'd need to complete a form or apply online for a tribunal hearing. Here's a copy of the form for you to look through - SSCS1. It gives you a space to explain why you disagree with the decision. I'd recommend going through each point and explaining why you can't do the activity.

    I’m so all over the place that I just don’t have the head space to complain or where to.
    I can’t switch off, I’m quieter and cannot even hold a conversation.
    Im in so much pain and cannot fight or argue, I never even hot seen before they just said no.

    Read the reason why I was refused and I’m so upset.

    Apparently I never sounded in pain when they spoke with me!

    And I was able to attend the meeting. IT WAS A CALL & I RECEIVED IT AT HOME WHILE SITTING ON MY SOFA.
    how could they be so cruel and who are these people.

    Can you get your husband to hightlight the lies and put a complaint in on the grounds of these lies they did it to me when i read the report i was shaking i instantly went to bed and stayed thiere i couldnt eat sleep sobbing then i got angry asked for MR and whislt doing that i phoned everyday pip line screaming what a lier she was obv i dont recommend that but pls dont be afraid of complaining they must get thousand of complaints daily because this happens alot i wish you so much luck

    On the Appeal a benefit decision form on gov.uk try and choose to attend the hearing as you've a much greater chance of success. On the form:

    1. If your appeal is over 1 month since the date on the Mandatory Reconsideration Notice you'll need to explain why its late. They are accepting of late appeals but you do need to show willing by giving a reason. This can include things like, the DWP letter being delayed in the post, delays getting appointments or help from charities or NHS, unable to cope due to your health condition or anything else which might be relevant.
    2. Where you have to actually write what you disagree with - keep it very brief. Just something like :'I disagree with the decision makers decision not to award me PIP for daily living or mobility. I believe I have difficulty with these activities because I have disabilities including [add disabilities here] which limit my ability to do the activities. In the interests of justice I would please like their decision to be reviewed by an independent tribunal.'
    3. Later, you'll get the DWP's response - called a 'bundle' review the bundle and then you examine all the paperwork and only then do you go through and write a letter to the tribunal explaining why you should be on PIP in more detail.
    4. Do a subject access request to your GP and/or hospital for their notes - this will be useful.
    5. Get anyone who carers for you to write a letter called a 'carers statement' explaining what they do for you and why.
    6. Do a PIP diary for several days.

    You can send 4 , 5 and 6 in to the tribunal in a few months time.
