LCWRA ENQUIRY

Hiya so this is a long one. I was put onto LCW in December 2024, then in December 2025 I was sent a UC50 form to be reviewed & reassessed, i didn’t request for this it was the DWP who requested this, I was told I did not need to send in fit notes, and that the 3month equivalent period would not apply to me because I was already on LCW, I filled in the form & sent it back on the 2nd of January 2026, I then had my telephone appointment on the 13th of may & got the decision on the 14th of may to say I had been award LCWRA, my assessment periods is the 7th to the 8th & my pay dates are the 14th & the 28th, i am wondering if i will qualify for the higher rate because i was already on LCW & if there will be any back pay, i also dont get the extra money for my 3rd child because it has put me into a benefit cap, will this be lifted due to being award LCWRA for me to get the extra money for my 3rd child.     Because the DWP initiated the review, no backpay is paid. You are first classed as having LCWRA in the AP in which the decision was made.

    So the higher LCWRA amount will apply to your current AP (May-June).

    The benefit cap should also be lifted for the same AP.

    hi thanks for getting back to me, UC have told me I’m only entitled to the £217 new payment because my decision was made after the 6th of April 2026

    I'm assuming this is staff replying to a Journal note of yours?

    They often give out incorrect advice unfortunately.

    Wait until your May-June payment statement.

    If you do get given the lower LCWRA amount, you can ask for a Mandatory Reconsideration of that decision quoting the official UC Regulations I've provided a link for, which show you qualify for the higher LCWRA amount.

    you got a decision very quickly , I wish mine was this quick, I only had my re assessment yesterday I’ve been looking for a update on my journal all day , did u feel like your tel call went smoothly
