Severe disability premium

Good morning,

can some one advise me thank you.

My wife and i were on UC, my wife claim her pension 2 months ago,' mix age married couple' so my UC claim is Nil, housing is been paid, migrated a year ago from ESA Support group to UC 'LCWRA' after receiving letter to do so. Still reciving New style ESA.

I am receiving PIP enhanced Daily living and mobility .

My daughter has been my carer for the last 8 years, and claiming carers allowance for her self. She was told last week that she could claim UC on top of her carers allowance

and wouldn't have to go to work or look for work as she is caring for me over 35h a week.

But today after she done a claim on line for UC i received a letter saying that ,

'If your carer is receiving a carers benefit, you will no longer be eligible for severe disability premium if you receive any of the following benefits,

Income based Jobseekers Allowance

Income Support

Income related Employment and Support Allowance

Housing Benefit

Council Tax Benefit

Pension Credit

We pay full Council tax, but receive full housing benefit, does this mean we loose our housing benefit? If my daughter claims UC?

    Hi,

    As your daughter was already getting Carers Allowance, that would generally stop you being entitled to SDP anyway.

    Are you sure you get SDP on your Housing Benefit right now?

    As a mixed age couple you are more likely to be getting Housing Element within your UC award.

    Housing Benefit is paid from local authorities for those of working age (including mixed age couples) living in supported or sheltered accommodation.

    Or in normal rented accommodation if the single person/both of the couple is over state pension age.

    As your Daughter has been getting Carers Allowance then that counts as a caring benefit, so you shouldn't have been getting any SDP within any Housing Benefit in those circumstances anyway.

    I dont know, i have for the last few years, not had to pay rent as each year maximum housing benefit and says as you have someone living with you who is expected to support themselves, a deduction must be made from your maximum housing benefit.

    But is 0. AS i am reciviing the daily living component of personal independence payment , no deduction will be taken.

    I just presume as i was on PIP thats why.

    On your UC statements, do you see an amount for Housing listed? That would mean you get Housing Element via Universal Credit.

    Yes i get the housing element see it on UC award statement.

    So you've no need to worry.

    Housing Element paid via Universal Credit is not the same as Housing Benefit.

    Severe Disability Premium is not paid under Universal Credit, only the income based benefits mentioned in your letter.

    Just the letter confuses me about severe disability premium no longer receive.

    Sorry, but i worry asking them dwp, my metal health , makes me worry and every time i get letters, it was stressful last year, with everything changing, i dont seem to be able to cope with stress after my wife had heart problems last year, and try not o worry her.

    It should be on the award breakdown letter for the applicable income based benefit.

    UC has now fully replaced the first three on OP's letter, so that leaves SDP only applicable to Pension Credit, Housing Benefit & Council Tax Reduction.
