PIP appeal
I applied for PIP daily living and my application was refused, I then asked for MR and it was still refused. I appealed to the FTT and my appeal was refused also, I then appealed to the UT and it was refused, the UT said it was the FTT who should have changed the decision. I then appealed to the Court of appeal and it was refused also. I went to South West London Centre to help me and they said either I pay £1500 to pursue this case or I made another new application. Since I am not working and on UC I then decided to make a new application with their help. This my 2nd application was also refused and I then went to CAB to help me with my MR. The MR was also refused. I then went to centre 70 to appeal to the FTT and they did it for me free. After about 4 months Centre 70 told me that they have stopped their funding and they have closed. I then went to Brixton Advice Centre and they then continued with my appeal. After a year from 17/07/2024 HMCTS contacted me and said they have got a hearing date for me for 01/09/2026. My representative from BAC then said she can't attend the hearing with me because they are short of staffs, she then opted for a video hearing which will be at their Centre, the tribunal then accepted it. On the day for the hearing when I was travelling to attend the video hearing, HMCTS rang me and said the hearing has been postponed, because a member of the tribunal has reported sick and they will give me another hearing date. They then give me another hearing date for 08/10/2026 and they said because my representative will be in Canada, I have to stay at home and do the hearing on my Laptop. Now what I am concerned with is if win this 2nd appeal, will PIP pay backdate for the 1st application from 02/02/2021 to 17/07/2024, because this my 2nd application is from 17/07/2024 to 08/10/2026. PIP has wasted my time and my representative said the they made the same mistake from the 1st application not taking into consideration the attack I had on 04/10/2021 and several front teeths and lower jawbone fracture, and also medical evidences from my G.P , Consultant Psychiatrist, Speech and Language Therapist, etc. After the assault I started wearing dentures which are prosthetics. According to the PIP Regulations, dentures are prosthetics and I should have met the threshold for the daily living component. That's why my representative said they keep making the same mistake and don't decide according to the PIP Regulations.

PIP has a very threshold and where do you feel a minimum of 8 points would be scored for Daily Living due to denture use? You have had many hearings so I think you need to consider that the correct decision is being made.
If you are successful then PIP would backdate to the date of your current application. Your first application was unsuccessful and the second one replaced it.
