Motability error- I now have two cars!

I was awarded only medium mobility with pip got the letter out to tell me I had to return my car to motability I accepted this and went out to buy myself an automatic car now I'm told by pip that my car doesn't have to go back what is the next step for me now have two cars

    Hi @Richard1960 and welcome to the community. Not a benefits specialist, I don't have an immediate answer to your question but I wanted to acknowledge 'receipt' of your post and to let you know that others will be along in due course who can give you more help.

    Oh dear!! I suppose if you want to keep the motability car then you would need to try and sell the one you bought?

    I phoned the pip helpline was told that it was not a problem to hand back my motability car on the due date hopefully that's it sorted but you just can't trust what they say at times so will keep you updated

    Yes motability sent me out the letter what imI entitled to where and when I have to return the car then I got a mandatory review was awarded high motability but in the meantime I have bought a new car

    If you return the mobility car you will receive the award as a cash payment. If you keep the car you bought you then don't have the worry of losing it at your next assessment which does give you more independance.
    If you keep the mobility car with the benefit of trouble free motoring would you lose much money by selling the one you bought
    the decision is yours but do look carefully at both options

    I know you have to pay insurance, repairs and breakdown cover but I have been informed that having your own car puts money to n your pocket it up to you how you spend your pip money having a mobility car is nice but it's dead money if it sits mainly on the drive or road how many miles a year do you do, me 5000 or under between mots.

    Yes that is true I have it nearly two years and just 9000 on it the problem I have now is that I was told by motability to hand back the car on the 20th of march in good condition and I will receive 2000 pounds and part of my deposit back I got a loan from a credit company and bought myself an automatic car but after mandatory reconsideration I was awarded high motability

    If you give back the mobility car you won't lose any money, you will be paid your award in cash to help pay for the car you bought
    If you sell the car you bought you will probably lose money on the resale

    Oh no.. What a nightmare. I am awaiting a decision but i don't think I will get awarded enough points to keep my car ( been on the scheme for 1 years ).. Waiting to hear so we can sort finance for a new car etc etc. Weighing up buying the actual car i have now from Motability. Hope that you get some answers soon!

    Hi I lose my mobility car in the next few weeks, and so I have done the same thing bought an automatic. I have just sent off to arrange a tribunal but this could take months. Steve

    I asked for an urgent tribunal because I was due to hand back my car before the original date was set. I was told by motabilty that while I was waiting for the decision I would be able to keep the car and that if the tribunal did not go my way I would have to give the car back but would not have to pay back any money I had used from my benefit. I won my tribunal and am allowed to keep my car. The dwp will now have to pay motability the backdated money they owe. Please ask the tribunal office to get you an urgent tribunal and talk to motabilty throughout the process.

    Hi, my car went back last week. I spoke to the mobility people who have been really good but they said because I hadn't been given a date for a tribunal I would not be allowed to keep the car until I get my date. I also contacted the DWP about when my tribunal is likely to be, but they said there is such a back list of people waiting it could take up to 12 months?

    How did your tribunal go? I am quite worried about what to expect.

    It was still about 3 month from when I asked for the urgent tribunal before I got a date. I guess they would have even more of a backlog by now. So many people are challenging their cases that the court's can't keep up. I think the dwp  just expect that people would give up at the first hurdle. I think they thought the disabled would be an easy target to claw back some money from!

    I took some advice from a disability specialist before the tribunal about the PIP criteria and they helped me to put together my case. The people at my tribunal were all women (as am I) and they all seemed to be very sympathetic. There was a doctor, a Judge and a disability specialist (I can't remember exactly what organization she was from). The doctor asked all the question and referred to the PIP report and the DWP response to my challenge. My husband had written down some things I needed to explain about why I felt th a assessor had got things wrong at my assessment. I would not have been able to cope without my husband. From the start of the whole process I would not have been able to deal with everything on my own. Please take someone with you that you can rely on to help you if you can't remember what you want to say. It's a very stressful situations to be in.

    You need to ring the Tribunal to ask how long the back logs are in your area and not DWP. Backlogs are huge is all areas, some are waiting 1 year for their hearing date. Hopefully it won't be this long for you. Goodluck.

    I went to Hertfordshire action for disability which is near to where I live. She wrote a short letter that was addressed to the tribunal to add weight to my case, saying that she thought I was entitled to the higher rate of PIP because of 2 points that the assessed had got wrong in his report.  You could ask the citizens advise service if there is anyone in your area that can help and advise about how to put your case in the right way. Good luck.
