Hi @rasb1, welcome to the community, I will forward you to @BenefitsTrainingCo for more information.
I hope you will receive help to sort the problem around benefits.
I would also put mandatory reconsideration forward and get advice or book the date with law centre to help with the appealing process.

    Wishing you nice weekend.

    Hi @rasb1,

Welcome to the community. I've moved your post to our benefits advisor category.

I hope you can get the support you need.

@rasb1 you shouldn't have to do a Mandatory Reconsideration for your PIP. ESA is separate and should not affect PIP. Has your PIP been reviewed? Have you had a face to face reassessment for PIP? If the answer is NO to these two questions then ring DWP and ask them why your PIP has been stopped. Don't mention ESA ! Let them tell you why they've stopped it. If it's because of your ESA assessment tell them it's nothing to do with PIP. Check your last reward letter before this one and use the review date on that to argue your case. If necessary get help from an advocate or your MP.

My pip was due only next year for renewal ,they sent me a letter as an award review.i filled it in as some of my conditions have gotten worst. They scored me all 0.In the decision letter it says the secretary of state has decided .............evidence and the further health consultation that you had for employment and support allowance.
I asked for an explanation and a mandatory reconsideration, today i got a call and the man says i will re look at everything but can you provide more evidence ,i said i have but i will get my GP to address this to you in a letter. When i said how can you base this on ESA Assessment ,he said we go by what the assessor has seen.I said but this is disability abuse as a lot of untrue information was filled in and i have forwarded to ESA my mandatory reconsideration.WHY IN THE WORLD IS PIP BASING ON AN ESA ASSESSMENT???
IM totally left in the dark.Should i call them again and ask them why?

I have heard they send review letters up to a year before it's due for PIP so it looks like that's what happened. I'm sorry but I'm retired and don't know a lot about ESA except my son's on both ESA and PIP and this could happen to him. Can I suggest you ring the SCOPE helpline and they will help you with what to do next. Just to say if you need more medical evidence you can ask your surgery admin dpt. or the receptionist about whether they can print off what you need from your medical records and in future if you remain disabled you can collect written evidence by asking for Specialists reports as and when you have any appointments. If it's just the GP you see than the information from appts. will be on your online records. Some surgeries have a system where people can register to see their own records and can copy and paste info. to be printed off them selves. Good Luck.

    Hi rasb1,

You've done the right thing by asking for a mandatory reconsideration of the ESA assessment and you should do the same thing with PIP.  The ESA assessment is unlikely to be directly relevant because it's a different test (looking at activities to do with the workplace rather than in your social and home life).  Make the point that the activities are different and what you can and cannot do for ESA may not illustrate your abilities in a non-workplace context. Also, they appear to have completely ignored what you said on your PIP renewal form - point out that they have ignored your own evidence about having got worse.

If you haven't already got a copy of the ESA assessor's report, do get one (it sounds as if you have it already but I'm not sure). It's a slightly complicated picture, in that I wouldn't say the ESA medical is completely irrelevant to a PIP decision, but it is NOT the same thing (the mobility activities are different) - and in any case, you know that your ESA medical report contained things which weren't true.

In your PIP mandatory reconsideration request you should point out that the ESA report just isn't valid - that the statements aren't true - and give evidence about what points you think you should get, in which activities. If you don't already have an idea about these you can use the PIP self-test to help you.

It's good that you have a blue badge through the assessed route so it is not dependent on your PIP score.

Make sure you ask for a written decision on your PIP mandatory reconsideration just as you did with ESA. You might also want to complain about the DWP making a decision based on the flawed results of a different test rather than taking into account what you yourself said on your review form. Finally, it's worth seeing if your MP might be interested in your case as it's always good to have their support when you are challenging a decision/complaining.

    Hi rasb1,

Yes the disability rights handbook is a good resource and will help you understand more about how PIP works, as well as the process for challenging decisions. Having said that there are lots of resources on the web which you can use for free, such as the PIP self-test and this Disability Rights factsheet about appealing.

Hi, I am hoping someone can help me. I have been recieving ESA support group for 2 years and have just been declared fit for work following my assesment in January. ESA has been stopped immediately. I am shell shocked, as on the previous assesment I got over 30 points, and nothing has changed except I have got worse. I have PIP awarded until 2020. Will that be taken away too? I have asked for mandatory reconsideration on ESA.

    Hi Skyblue and welcome

Your PIP award should not be affected but be aware that reviews usually take place a year ahead of the end date so expect that in 2019

As always if you can get f2f advice from CAB or similar you should do so

ESA and PIP are separate benefits, with separate claims needed and different criteria to meet

Can you help me please my sister had an ESA assessment done they found her fit to work so they stopped her benefit and told her she could appeal which she did but as she had no income apart from her PIP THEY TOLD HER SHE NEEDED TO CLAIN UNIVERSAL credit which she did anyway to cut a long story short because of all the medical evidence she was able to supply they told her she didn’t need to go to the tribunal hearing as they cancelled it and found in her favour . So now she’s been declared unfit to work but they have said she can’t go back on esa but they have said she’s not entitled to the added premium of £117 as all new claims are barred from receiving this on universal credit . What I don’t understand is if she’s not entitled to the extra money why did they tell her to appeal she spent months worrying herself sick all for nothing . They made a mistake in taking her off esa but because she couldn’t wait 9 months with no money she is still being penalised for their error how can that be right .
