Hi everyone, I have lost my higher rate and been put on the standard rate, this means I have lost my car etc. Can anyone tell me what to expect at a tribunal hearing? I haven't been given a date yet as I only sent my form of about 3 weeks ago.

Thank you, Steve

I forgot to say I was awarded the lower rate after the assessor told lies on her report. Steve

Hi @ste350, the timescale see,s to depend on where you are in the country.
The tribunal are usually 3 people and they ask questions on how you are now, not when you actually have your hearing so keeping a diary is a good idea incase you have a long time to wait.
The questions they ask is anyone’s guess, every case is different so it’s hard to give you an idea.
there are posts on here with plenty advice and peoples experience of their tribunal so just have a look.

    hope this helps

Hi, can anyone tell me what this means?

I have sent information to appeal at a tribunal about six weeks ago. I have just received a text message saying "We've received the written report of your pip assessment. We will write to you once we've made a decision about your PIP. As a guide you should hear from us within 4 weeks. Has anyone else had this message and does it mean they are going to contact me with a tribunal date? Thanks Steve

Who was the text message from....the DWP? If it was from the DWP which i'm assuming it was then ring them and ask because they're the only ones that can tell you what's going on.

Usually a Tribunal hearing date takes months because the backlogs are huge, i i highly doubt it's to do with that.
I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
If i see a question that i know the answer to i will try my best to help.

Hi everyone, it has now been 6 months since I was told I would be having a tribunal. Still haven't heard anything. Where can I get extra help for my tribunal? I have doctors reports etc. but what else could I get to help my case?

    Thanks, Steve

Tribunal backlogs are huge a in a lot of areas and some are waiting 1 year for their hearing date.

Are you getting any help from cab or welfare rights? Or any other organisations?

I contacted welfare rights yesterday and they are going to contact me asap. I am going to contact Welfare benefit information centre today. I have been told to write two diary sections in detail per activity. Does this mean a full day or just the particular activity that I am unable to perform? But are these stories about how I am at the present or how I was when I had my assessment?

Disability Rights UK site has a draft diary that will be of help: it's set out in table form, times of day along the top, activities down the side.  I assume two diary sections means a diary for two days for each activity.  The diary should be for how you were at the time of the assessment, not as you are now.

The diary could be very important as my tribunal based many of their questions on the 7 day diary I submitted with my PIP application.  Tribunal awarded me enhanced both components.

Well it's been 12 months and yesterday I was at the Magistrates Court for my appeal. My wife had sent extra information to the courts which the Judge and panel seemed very happy with and so they had already made a decision about daily living component before we entered the room. After about six questions about mobility, I was  also awarded the higher rate. This should have never have happened, a total waste of time and money all due to the assessor who I found out was a information manager? told lies on my assessment. Why don't DWP contact all the specialists, doctors etc. by mail. This would save a lot of misery and money. Glad it's over for another 4 years. I would like to thank Preston Welfare Rights for all their help and support.

Hi Sally 1966 I hope your son has been sorted by now, it's a terrible journey but hopefully he will get what he deserves.

PIP is not a medcal assessment but a functionality test. Writing to doctors and specialists is taking up their time for treating other patients and is not that productive as most will not have first hand knowledge of how you are affected
