Esa 3 reassesnent and how long it will take?

Hi there I have been sent a esa 3 form around 2 weeks ago and have replied and send it off around Monday around 4 days a go 1st class. The change is the fact that I am married but do not want to claim for my partner and she isn't working though as she is looking after me around the clock. They also have suspended my payments until I sent the form which I have as mentioned. Any ideas of how long it could take?

    Hi,

    It could take a few weeks at least.

    Why do you not want to claim for your partner? It should be a joint claim because you have a partner that doesn't work.

    She's doesn't want to claim as carers allowance is sufficient for her....everything is the same since my last claim including details and illness the only thing that has changed is the fact that I am now married and the only income she has is carers allowance from looking after me constantly as I have had a transplant twice nearly 3 times. Only worried as they have suspended my payments till they review it and the only income I have is pip and carers and half of that goes towards the motability car. I'd of thought it would be a quick recalculation due to nothing has changed apart from I am married and my wife looks after me and has no income apart from carers.

    I'm not 100% sure on this but she may have no choice to be put on your claim because she's your partner. If she was put on your claim you would be better off per week by about £70 ish. I don't understand why you wouldn't want that extra money. :o

    She's is already claiming ca and doesn't need anymore also she thinks the decision making will be a lot longer and we are struggling at the moment and at the same time nothing medically is wrong with her but she has to look after me all the time and isn't bothered to go to atos medical examination

    There doesn't have to be anything wrong with her, she's your partner and you should be claiming ESA as a couple. She would not need to attend any assessments because she will be on your claim. You are the one who will have to attend assessments.

    Oh okay I see. Sorry I don't really know how it works as I have had my assessment a couple years ago and got put in the support group I think I'm not to sure but I could check. What will the process be as nothing has changed illness wise and need looking after only difference since 2-3 years ago is I am now married. It isn't  a total excuse but I got married 10 months ago and didn't realise I had to tell esa I blame my aspergers syndrome. I have to do notes constantly or else I become depressed a lot more frequent then usual

    This is most likely why your ESA has stopped because you should have told them that you married 10 months ago. They will re-assess your income now and add your partner to your ESA claim. As you're a couple, that live together, you claim as a couple and you have no choice for Income Related ESA. It should have no affect on your place in the Support Group and you should still remain in there.  Hopefully for you it won't take too long.

    I know your partner is your carer and they claim Carers Allowance but do they work at all besides this? If they do, then it's possible you will will an over payment from your ESA.

    Did you inform your local council that you married? If you didn't or haven't then you will need to do this tomorrow. If you were still claiming council tax reduction as a single person then you will owe them some money because of the single person reduction.

    No she doesn't work at all her only income is ca and we live with my parents at the moment as she looks after me she's not able to and I know it's a mistake not reporting it but I honestly didn't know it have lists of things I need to do everyday and what to buy (food drinks) as I'm severely underweight I'm on tube feeds and had a liver transplant 2 times and have depression and anxiety and aspergers syndrome and make a lot of mistakes unintentially that upset people but she doesn't work and I have written a little note apologising hoping they'll accept it. And roughly how long does it take average because I hearts 3 months and we are struggling at the moment? Also I appreciate you replies and help you've given me hope n lessened my worry and stress as I'm also on sleeping tablets which help me to sleep as if I don't use them I'll only sleep 2-3 nights a weeks but this has stressed me out Where I may need to get stronger ones so thankyou so much

    You're very welcome. I honestly don't know how long it will take. There shouldn't be any overpayment on your ESA because you should have been claiming more money as a couple anyway. As you've told them not, everything should be fine. They will just add her to your claim. Her Carers Allowance will be deducted from your ESA and a Carers premium will be added.

    Hopefully it won't be much longer. You could ring them first thing tomorrow to ask if they've received the form and how long it will take. They will tell you. Good luck.

    Thankyou for youbfast replies and much appreciated I send it off on Sunday I think Monday and phoned them up on Friday and they said they haven't received it although I put a 1st class stamp but it could be in the sorting process and I should phone on Monday Tuesday or Wednesday after 1 I'll keep you updated and once again thankyou

    So I've sent it off on Monday the 11th june and today is the 20th of June and when I rang them up today they have still NOT received it and said it could still be in the sorting depot and that it hasn't been scanned. They said if it hasn't come by tomorrow then I might just have to go to job center and get another form and fill it and send it over again which is a annoying and can't be right. I phoned up royal mail to double check about post in my area and no problems and the post was apparently picked up and if it's in the depot it might not arrive till 23rd June and I phoned again about times of collection and another lady said if it's in the depot it will be arriving by 26th June. It's really confusing.

    That will only be 7 working days from the time you sent it. You don't count weekends because DWP are closed. Post can sometimes take anything up to 10 working days to arrive at the correct department and be scanned onto the computer. Did you send it recorded delivery? This means that a signature would be needed when it's delivered. At least sending it this way you'll know it's arrived at the sorting office. Without that then you have no proof it was sent.

    Hi guys sorry haven't been on since then I have been ill. I was awarded my money on 28th June. Reason is I demanded it gets scanned over as opposed to sending it and some reason the first form still hasn't arrived.i have not been back dated which I'm not fussing about as I should of told them earlier on but my aspergers plays a part (not excusing it) i didnt revieve my back date for the past 10 months for the new rate nd asked them to look into it. A few days later I get left a voice mail stating I shout right a reconsideration letter and wether I win the case or not I still have to? Is that possible

    So the reconsideration letter is about arrears of ESA and the case you are fighting is about what?  Sorry, I have joined the conversation late, I guess.

    I agree that if you want to challenge the non-payment of arrears of ESA, this would be a mandatory  reconsideration against the award notice from 28/6/18 awarding a new rate of  benefit. Your challenge to this is that you consider it to be from the wrong date. You would need to say why you informed the DWP late about your wife and see if they consider that to be "good cause. 

    Not sure about the rest of this . It's not clear to me what the other case is.

    I just asked dwp and they said the sooner the better but I'd I don't then they won't even bother with the case and what has gone in the past I am not really bothered about it and haven't got the energy to fight back. My last question to you guys is if my wife works full time what will happen to my esa and pip inknownthat her carers allowance will go and like before my mom will just look after me as always has in the past will I just get what inhad before or will the esa cease as well as the carers allowance. Sorry for all the questions guys I don't know about these things just that i am in the support group and that ive had it for approximatly 2 years. Once again sorry but this is the only place i can ask as dwp are stubborn to answer and quite rude most of the time after waiting minimum 1 hour+ for someone to talk to.

    Hi mohamed

    If your wife works full time - defined for employment and support allowance purposes as 24 hours per week or more, then our income-related ESA stops.

    If you have contributory ESA, this carries on indefinitely, as you are in the support group.  If you were in the work-related activity group, then it only carries on if you haven't yet been paid 365 days'  ESA already. 

    PIP isn't dependent upon your or your partner's work status, so there should be no change there.
