Will I loose my backdated PIP?

hello, i have had a payment into my account so i must have been successful with pip application but no award letter yet.  so very relieved as it will be a huge benefit to me as been struggling on esa support group money.

can anyone advise if they have experience of bankrutpcy which was a huge step and a charity has provided me with support to go through process but they are not expert in benefits (not discharged  as only recent and no ipa)
we have emailed the official receiver (or) with help from daughter to explain i don't have figures yet but i have had a payment.  Will i lose the payment as its a lump sum back dated presumably.

i am terrified of this, i may as well not have it if i have to explain every single thing i spend using it. Official receiver has access to my account so would know anyway but we thought we should tell them.  so worried.

Hi @livonia and thank you for sharing this with us. This must be an incredibly difficult time for yourself. I personally do not know the answer to this but hope @BenefitsTrainingCo or someone on the community will! Please do keep us updated and if there is anything else we can do then please do not hesitate to ask!

Being Bankrupt does not affect your benefits and any payment you receive including lump sums cannot be used against you in bankruptcy proceedings so you should be able to keep it.

As an ex Examiner for the OR you will be able to keep all of the PIP money.
When looking at making an IPA benefit money is generally not taken into account and certainly not a benefit in respect of a disability. Mainly they are made when there is enough money left over out of earned income.

I think you need a money adviser to answer this - unfortunately I don't know about bankruptcy. You need a debt specialist, rather than a benefits specialist. I'm afraid I simply don't know enough to comment on Yadnad's advice.

If the charity who are helping you don't know then I would ask a money advice charity such as National Debtline or Step Change.

The poster is well advised to telephone the OR and speak with the examiner involved in their case. They will record the advice given and reassure the bankrupt.

Hi there - I was wondering what the outcome of this was. I was made bankrupt sept 17th 2018 and I will be receiving a back payment from PIP  this back payment is from August 18  to jan 19. My question is can the Official Receiver take it because it’s disability related because I’ve had cancer? I don’t have any savings whatsoever or any money in my account I live solely off benefits at £1054 per month? I need advice please

Hi @charlie27, and a warm welcome to the community!

I'm sorry to hear about your circumstances. Perhaps our members can help, although as advised above, it may be best to contact a money advice charity such as National Debtline or Step Change.

yes mine was not taken into bankruptcy . I did email official receiver to cover myself and Sd I had a new award for pip backdated and she Sd I didn’t need to notify her of benefit income as it’s only if my employment status changed they needed to know.

Wow that’s a relief to hear - So basically you had been made bankrupt and then received a back payment of PIP and it was ok to keep and not classed as a ‘windfall’? What if it’s over £3000?? I’m so worried as I need this money to get by as I’ve bortowed so much from friends and family already

She was not interested in any figures as she Sd only earned income was notifiable .  If yu are worried to cover yourself just email and say do they need any notifications on changes in your benefit payments that’s what I did as I thought I had to. I am discharged this July and didn’t want to do anything to prejudice discharge
