Tribunal in April - dreading court case

Hi I'm Julie, I have COPD and fibromyalgia and depression/panic disorder I previously had dla low rate and managed to work 16hrs but after my last two diagnosis COPD and fibro to cut long story short my dla was stopped and pip scored me zero points, i have my tribrunaral end of April took 15 months waiting depression got so bad been off work on ssp for ages and occupational health have also signed me off because of my progressive illnesses dreading court case

    Sorry to hear that only advice I can give you is make sure you get all relevant letters from doctors dating back as much as possible. Make sure he lists everything in there how your illness is effecting you and so on. More info the better chance you have winning tribunal. Also make sure you go with someone as then you stand even more chance of winning the case.

    Well it was adjourned in December as the cap had not requested my medical notes so they adjourned so as the courts requested my medical notes themselves, I also have a report now from Sainsbury's occupational health. Thanks for the advice

    Ideally, you want to chat with one of our benefits specialists about this situation, and they will be in touch with you just as soon as possible. The combination of it being the weekend and their having a ridiculous amount of work on hand may slow things down a little bit but they're very quick off the mark.

    Hi juliesr

    Have you sent a copy of the OH report ?
    If not and it is helpful to your claim, you should send a copy to the tribunal asap.You can submit further evidence usually up to 7 days before the hearing.

     DLA and PIP use different criteria for awards

    The tribunal are only interested in how your condition affects your functionality, medical evidence is only usefull for explaining the why

    So be prepared to answer questions regarding your functionality

    I lost my tribrunaral and have had to make a new claim for pip but capita keep sending me appointments for Cardiff wich is an hour and half away

    I can't travel there and have told them and now they have sent me another assesment yet again in cardiff

    If a home assessment is required then you'll need a letter from your GP stating the reasons why you can't attend. When you rang them to cancel your first assessment did you tell them you couldn't travel that far? Did they not offer you another assessment date and time closer to home? You can only cancel an assessment once. 
    I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.

    Did you make a new application straight after losing the first at a Tribunal?
    If so you may well find, unless this second claim has been completed in such a way that it shouts that an award is due, that the DWP will view the second claim in the light of the previous failure.

    Can't believe it, I rang pip to say I need another pip assesment and explained that I couldn't travel to Cardiff and they agreed capita were wrong to ask me to go there and they would contact capita to advice them that I need a home visit or a closer venue like Hereford and
