Hello. First post. So i won my sons tribunal from November 2017. As i was waiting i had more evidence and because im new to this i phoned the DWP to ask about sending it in they said it'll be easier and quicker with new evidence to do a new claim, so i did. Also refused. Anyway i left it. Went to tribunal august 18 and won HRC from nov 17 till january 19 as the tribual award letter states. Now ive found out that cause i lodged another form whislt waiting even tho it was refused the tribunal decision doesn't stand??? Is this right. I had no idea and wasnt informed , im absolutley devasted. please help

    I’m very very sorry to hear about your current situation/problems.

    I do think that we need some “Experienced Advice” with this if that would be ok????

    We have got some “Benefit Advisors” here on our site.

    I will forward your post onto them straightaway.

    Unfortunely they are currently very busy so I can’t give you a timescale for there response????

    Thanks very much. After finding this out I am now very low and feel like giving up. 9 months wait for nothing

    Time line if it helps 

    Renewal declined November 2017 so applied for tribunal 

    January 2018 new form as per the instructions of the dwp advisor 

    April 2018 decline 

    August 2018 tribunal decision won

    Also the date on the tribunal decision states 25/11/2017 till 01/01/2019

    It was the wrong decision to start a new claim as you have lost your rights to the original claim 
    It was bad advice for you and good for the DWP never trust what they tell you always seek independent advice

    I must agree with you. My extensive history with the DWP tells me time and time again NEVER accept or believe anything that the DWP say or do. Far too many instances of the DWP giving out wrong or misleading information. Just had a look on rightsnet and the Pension Service are still at it years after my run in with them. Seems they are now causing problems in telling potential claimants that they aren't entitled to Pension Credit and doing so without taking full and complete information into account.
