Hi, my brother is only 4 months in his 3 year motability contract, and DLA have decided he’s not entitled to enhanced anymore.
While he asks for a mandatory reconsideration & maybe an appeal, will he get to keep the car?
Please if anyone can help how he can keep his enhanced. He’s so ill. All because one DM has decided he CAN walk 50 metres when he can’t. It’s outrageous. all this stress is making him so much iller.

Hi,Do you mean PIP and not DLA? DLA no longer exists as it's now PIP and if you were over 65 on 8th April 2013 you stay on DLA and won't be re-assessed at all. It doesn't make sense that he lost his mobility award under DLA rules.I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying. If i see a question that i know the answer to i will try my best to help.

He lost his enhanced. He’s only 57. Which means he’ll lose the mobility part.

Enhanced mobility is PIP not DLA. Unfortunately he won't be able to keep the car while waiting for MR or Tribunal, if it gets that far. Motability will be in contact with him with further details.

Yes, the car will be repossessed. The good news is that if/when he gets a new decision for enhanced mobility he can go and choose another car from Motability.
Many people lose their cars for this reason, I lost three of them in the past 5 years.
