I'm appalled by my assessor's comment

Whether they 'can do this' is a big question, but I agree it's offensive. You can complain about her. The complaints procedure is here for ATOS and here for Capita.

Arguably this is disability discrimination (there isn't any specific discrimination legislation about size but it can be argued it's a form of disability discrimination potentially). 

 It's possible that the assessor's attitude to you influenced her assessment of your disability and that's obviously caused you problems or you wouldn't be appealing! I would probably not dwell on it in the tribunal though. It's not something which they'll be interested in as they will want to ask you questions about the PIP activities and what you can & cannot do. I would focus on the activities relevant to you & what you should have scored. 

You could say that you have complained - it's not essential to do so, but that way, you're separating out her attitude (which the tribunal can't do anything about) from getting the right PIP decision, which hopefully you will. If you feel that the assessor's generally negative attitude was part of the reason you didn't get the right PIP award, or maybe not any award at all, I'd make this clear in your complaint. 

One claimant even sued in the county court because the assessment company had caused her such problems - however this is quite a bit step to take & I think she was successful because of the big financial & health consequences the wrong PIP decision had.

@angrymom2019 so my last assessment in jan 2018 said the same and exact words and yes I complained but they took no action and i got a call from capita out of blue last week to say my f2f assessment is cancelled am like I didn’t have anything booked I asked if I can make a complain cus I won my tribunal but she said you can’t its over 1 years old and your won so it doesn’t matter I told her to f off

they asked me how POS affects my life, i was very anget by this point and i said " well to her then bleeding for months or not at all the pain of it that leaves me unable to move and losing my twins at 23 weeks im fine " i got told not to rude to her! at this point i burst into tears and was told to stop as she needed to get the assessment done. she was lucky i was to weak to throttle her 

Hi to all and hello to Pippa you are correct and everyone should mind their language, but it is true these pip people can push you over the top and sometimes the only safety valve you have left just blows and sometimes that is the wrong language. I read my f2f report from the assessor I was appalled that she spelt dosset box dosssette, and even worse she spoke of small type package medication and the bigger type medication and for bigger  she actually wrote the word  N....R. ( I have left dots but the word starts with n and ends with r) so you may have some understanding what that word is. Coming from a background with multi-cultural family members you may understand have very offended I was to see that word in my report even if it was a spelling mistake on the womans part. most offensive to me.
