Should I take my PIP decision to tribunal?

I have Fibromyalgia , hope there is anyone who can really help me

1 I applied for pip in September  2018 received refusals in December 2018 was given a mandatory notice but as of my severe pains and mind fog and 27 other pain and mental related issues  I couldn't take them to tribunal

Last 3 days my motivation has increased of the blue feel  what should I do 

As I deserve PIP should I take dwp to tribunal...are there private lawyers who can do this for me as of my health

Whilst can I also put on a new application

Please guide me all possible ways to get pip please please

Wait for a very specialised advice as I deserve it but don't think dwp knows what fibromyalgia is

    Hi,

    There's a lot of people that suffer with fibromyalgia, but it's not about a diagnosis, it's how those conditions affect your ability to carry out daily activity based on the PIP descriptors. Everyone is affected differently and you can't compare 2 people. No one can guide you to successfully claim PIP.

    You need to prove how your conditions affect your functional ability. They very rarely contact anyone for any evidence and the onus is on you to make sure it's sent to support your claim.

    You do have 13 months to request the Tribunal with good reason. You'll need to MR decision letter to be able to do this otherwise they will refuse your appeal. You also need to fill out the SSCS1 form and send the MR decision letter with it. Putting the reasons why you didn't request it within the 1 month deadline.

    I wouldn't advise starting another claim because if you use the same evidence you previously used, you'll likely see another refusal.Tribunal is the best way forward. If you start another claim then any new decision will overrule the Tribunal decision.



    Appearing in person will give you the best chance of a decision in your favour and 71% of those that do are successful. Only 5-8% of paper based decisions are successful.

    Waiting times for Tribunals are huge across most of the country and you could be waiting in excess of 1 year for a hearing date.

    There's advice agencies out there that will help you for free, there's no need to pay anyone.
