hi all sorry not been active for a while hope everyone is ok and can help me so last year won my tribunal anyway going through another one now but in march this year it's got adjourned due to activity 1 daily living as 2 hcp reports gave different results 1b and 1e and now today 14 of June there's a different reason and that is my MRI reports in 2013 and 2015 which both show my disabilities and was good enough last year at the tribunal but not this year I'm so confused and upset and depressed this as been going on since January this year please can anyone help me x

    HI,

    I would advise you to get some face to face advice because it's extremely difficult to give any advice because no one knows your case or how your conditions affect you.

    One thing i will say is that with evidence you do have to be very careful that one piece doesn't contradict another. Sometimes less is often more.

    hi @poppy123456 thank you for the link and advice the evidence I used this time round was the same as i used last year in march but and 1 extra piece of medical report that i didn't have last year will look at the information on the link you sent me thanks again x

    I think because the last MRI is now four years old is why they are being difficult,, i had a similar problem with not enough recent medical records even though my past MRI stated degeneration of the spine, i would ask for another MRI both at low and one at high resolution ( they always seem to do low first )  i would see your doctor explain the situation and ask for a new MRI scan,,, unfortunately the new way they assess people is in effect trying to deny the benefits they deserve,, even during the assessment say if you cannot stand,, they will write down you refused rather than you cannot stand,,,  so yes start again at the doc's ,,sorry i cannot give better advice,, very best

    @veeleather - Would an NHS doctor authorise a scan for a benefit claim? I don't know for certain but I don't think mine would as they don't come cheap AFAIK.

    Curiously I had a different experience - I'd had various scans etc to diagnose my condition and the most recent were 7-8 years old. 

    I suppose much depends on whether you need to have scans as part of your condition?

    hi @cristobal hi @veeleather thanks both and spoke to doctor and there's no way i can have another MRI scan just prove them wrong  my other 2 I've had show the same disc problems and stenosis fibro and to other many things lol also the reports and medical letters ect say what's wrong with me and they've said in the long run its its  going to get worse and over the past 10 years it has done and the person i rung for advice at was a waste of time didn't help in any way so I'm just going to answer the questions they want answering and this time I'm sending pictures of all my adaptions I've got fitted while I'm waiting for an adapted house thanks both x

    Hi @cher77, I'm sorry you're having to face another tribunal so soon after your last. Have they given you a new date yet? Did they say what exactly the issue with the MRIs was, just that they are old?

    hi @Adrian_Scope all the evidence i sent in this time is the same evidence as last year and won the tribunal this is why I'm confused even the medical reports from the specialists I've had at the time of my scans to my most recent reports still back up my condition and disabilities ect even saying that it's a degenerative which will get worse over the years and which it has done this is the 2nd time it's been adjourned 1st time was due to the DWP/pip to prove i don't cook ect I'm really at my wit's end and can't seem to get any help or advice still waiting for cab to get back to me

    You really do need to get some face to face advice because if you continue then your existing award could be reduced or lost completely. It's impossible to give any advice on an internet forum because no one knows anything about your case or how your conditions affect you.

    Of course it would be a terrible thing if you were to collapse in pain while out,, needing an ambulance with a hospital stay then as what happened with me, i got two MRI's one at standard and one enhanced stating quite clearly my current condition,,, i certainly would not wish anyone should collapse while out,, or have to go to such lengths to get a current MRI mind,,
