Del have sent no papers to tribunal

Hi
Began the appeal process in February and received confirmation from httcs that they had received my appeal.
Heard nothing more till 5 weeks ago court sent me a letter stating that they had had no response from dwp and directing them to send paperwork within 7 days .  They also asked me to send all my paperwork to them as dwp haven't bothered. I did this immediately.  My question is what happens if dwp still fail to respond which I'm assuming they haven't as I still haven't received any case files .

    Hi @kentpete123 and a warm welcome to the community! It may be worth giving Citizens Advice a call as they'll be able to give you more detailed advice. There is also Local Advice if you want to get face to face advice. I hope you managed to get it sorted as it sounds like it'd be stressful!

    It's just weird because I can't find any reference to it happening before. I know they won't just find in my favour just slightly confused as to how dwp can get away with not engaging with the process at all. !!!

    I have to admit it's a new one to me! I'd definitely recommend getting specialist advice. Please do feel free to keep us updated in how you get on!

    @Chloe_Scope and if the tribunal find in my favour will the dwp acknowledge it or appeal because they weren't involved

    @Chloe_Scope I rang tribunal service and all they said was dwp still haven't replied and I have to wait for a date for the hearing

    It is not unheard of for DWP to not attend, but this shouldn't go against you. I hope you're not waiting too long for a date!

    @Chloe_Scope hi today I have received all paperwork from dwp but none of the medical info I sent to tribunal are included so still confused lol

    You need to contact HMCTS because anything you send them should them should be sent to DWP by them.
    I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.

    Not sure if this is from dwp not tribunal as it says they have sent a copy to hmcts and my representative @poppy123456

    But I thought they send it to tribunal then tribunal distribute it

    The bundle is sent from DWP. If there's evidence missing from this that you've sent to HMCTS then it's these you need to contact because they should have sent this to DWP. As you have a representative, they should be explaining all of this to you.

    Ok I'll ring them it's very difficult to get to see my representative as they are really busy

    @poppy123456 quick update I phoned HMTCS they received my medical evidence on 7th of June she is going to look into why it hasn't been sent out and send it if nessecary. I also asked when I should expect the tribunal......at Margate where mine will be, the waiting time is currently 60 weeks!!!!!! And I'm on week 22 so won't be this year

    Hi I attended my pIP appeal after waiting 14mth they then adjourned it to lack of evidence they want doctors letter etc bk in for 21days time i hope it’s not another 14mth wait I would of thought not with asking for letters back within 21days time

    HI,

    They can adjourn the hearing if there's not enough evidence to make a decision. Once they have a new date they will contact you. Hopefully not too long. You'll need to make sure you send the evidence they've asked for within that time frame. Good luck.

    Great news, i'm assuming DWP changed their mind and placed you into a group? As i see you only very recently requested the Tribunal.
