Awaiting my PIP tribunal

Hi this is the my first time on any kind of forum but I have been helped a lot by the comments on here. Glad I'm not alone.

So I'm waiting to attend a tribunal hearing about my pip application. I was on dla for many years as I suffer several debilitating conditions including arthritis, scoliosis, fibro myalgia, and depression. The pip assessor lied about everything, and I even have a copy of a fake physical assessment when they state through out the letters that I refused to do a physical assessment - a lie, they wouldn't do one. And then state the physical examination was done with my full consent!

That must be incredibly frustrating @TEACUPTERRIER. Many of our members have had unfortunate experiences with the PIP assessment process, so you'll be in good company. Have you been given a date for the hearing?

No date yet. I'm gathering my medical evidence to send. The whole thing is full of lies, and I have a copy of a physical examination that never happened, even though 6 times throughout the letters they claim I out right refused to do a physical examination! And I can prove I had a strained tendon in my left knee at the time of my assessment, and it was impossible for me to do the movement it says I performed on the fake physical examination. Can I use this information some how? This examination should not be allowed into consideration as I can prove it's fake!

This has caused me anxiety, insomnia and extreme stress as well as financial difficulties. I just don't know what to do.

Hi spiceman. I have my gp's full support. Im also seeing a Councillor about my depression but I only got an appointment with her after my application. I've informed them. In the letters I have received from the dwp it says I didn't want them to contact anyone or receive information from dla but this is a complete lie. I gave them all the information about specialists and my dla but they say I refused.

I was also told to give them the contact information for all my doctors and not send paper copies of medical information as they prefer to get the information themselves.

My only income now is esa which goes into the household for things like rent and food

Hello @TEACUPTERRIER Thank you for reply, that I know myself is fine to have.

The difference is all support workers help you, at any Assessments, speak on your behalf.

Tribunals anything .

In your case first fill in form for you, put in a report from them, great you have specialists were they there on the day to support you.

My support was speaking to assessor about reports.

Add went to Doctors with support worker, discussed me.

Rehearsal days before.

Going through everything.

Please this is something I have done, had my Issues thirty years long term, use knowledge, education learnt from the experiences.

To pass onto Community Members, have a lot of experience since early Eighties Medical Assessments, Benefits.

Mental Health systems, procedures. Worked volunteering Mental Heath Charities.

Qualifications gained. Use Nutrition, diet to help others . Anxiety related, food diet issues.

Have addiction history. Clean use that knowledge to help others.

Lot of this from support workers Charities.

Please can I just add many charities will help if you wish to help yourself. Be positive, say Yes to anything.

Opportunities arise, new avenues, new paths.

As now have this present time no support use what I have learnt to cope.

One final point had an assessor be critical of me, in front of support worker.

A feisty one my support worker.

Intervened made a Complaint plus sharp rebuke, if not for any of them. Useful, helpful guiding light.

My support workers all them intervened spoke up, made me strong have courage.

Never ever be here, sorry but true.

Life is so short.

Please something to consider.

HI and welcome,

Firstly, please be aware that PIP is very different to DLA. PIP isn't awarded based on any diagnosis, it's how those conditions affect your ability to carry out daily activity based on the PIP descriptors.

My advice to you is to ignore all the lies and contradictions that may have been told in the report because the Tribunal will not be interested in any of those. All they will be interested in is where any why you think you should have scored those points. You can't prove what did or didn't happen so it's better for your case if you forget what did or didn't happ during the assessment.

A poorly presented case often leads to refusal.

For your submission to the Tribunal you should put in a letter where you think you should have scored those points and your reasons why. Adding a couple of real life examples of what happened the last time you attempted that activity for each descriptor that applies to you.

Despite asking on the form for names of medical professionals they very very rarely contact anyone for any evidence. The onus in always on the claimant to make sure evidence is sent to prove you qualify, it's not their responsibility.

Before sending any evidence you have i'd advise you to have a look through it carefully and only send evidence that relevant to the PIP descriptors and how your conditions affect you. Sending huge amounts of evidence if it isn't relevant is pointless because it won't help your claim.

I'm assuming you're planning on appearing in person at the hearing? This will give you the best chance of a decision in your favour. Paper based hearings have a very slim chance of success.

Ridiculous, though, isn't it? The assessment report can be - and often is - a work of fiction, yet you're not allowed to challenge it as being an unsafe basis on which to make a decision.

It's not ridiculous really when you think about it. You can't prove what did or didn't happen during that assessment. The HCP that assessed you most likely won't remember assessing you because of the amount of people they see. Why challenge the assessment report when what you really should be doing is proving which descriptors apply and why.
