PIP assessment scored 0 points for everything so awarded nothing. Mandatory reconsideration remained the same. 42 weeks in & waiting for tribunal date. Has ESA assessment with Nurse and put in the limited capability for work category. So confused and have sent the ESA letter to the tribunal office as more evidence but how can you be marked 0 then assessed as having limited capability? I am supporting my Friend with this thanks for any advice that may be available

    Hi and welcome,

I'm one of the community champions here on scope and i'm here to help and advise others.

PIP and ESA work capability assessment are both completely different benefits with totally different criteria. PIP isn't about not being able to work because people claim PIP and work. It's about how your conditions affect your ability to carry out daily activity based on the PIP descriptors.

For the submission for the PIP hearing your friend should state where and why they think they should have scored those points. Adding a couple of real life examples of what happened the last time they attempted that activity for each descriptor that applies the them.

Having some understanding of the PIP descriptors always helps and i'd advise you to have a read of this link.

Do be aware that the Tribunal will only be able to take into consideration what their condition was like at the time the original decision was made, any worsening of condition won't be considered.

Backlogs for hearings are huge across most of the country and lots of people are waiting about a year for a hearing date.

    Good luck.

I would appreciate it if members wouldn't tag me please. I have all notifcations turned off and wouldn't want a member thinking i'm being rude by not replying.
If i see a question that i know the answer to i will try my best to help.
