If you receive higher rate for mobility and daily living pip do you automatically qualify for lcwra x

    Not unless you are over pension age.

    Hi there 

    The answer is no they are seperate benefits have different criteria pip is about daily living and mobility lcwra is about abith yo undertake any work 

    You need to report a medical condition for ocwra provide fit notes then fill in forms and have an assessment 

    Pretty mych same sort of process as pip but different criteria looking at workplace ability

    Unless you are over pension age in which case getting PIP can give automatic entitlement to be treated as LCW or LCWRA.

    @calcotti. This is rather confusing to me. How can someone claim LWRCA if they are over pension age? I thought that was for those of work age, that couldn’t work due to illness etc.
    Or is it a different case if you’re already receiving PIP, reach pension age, and then you could claim LWRCA?

    If they are part of a mixed age couple (one pension age, one below) a person of pension age will be included on a UC claim. You are obviously correct that a single pension age person would not be claiming UC.

    It is confusing and has only applied since 2019. Before than mixed age couples had access to pension age means tested benefits but government switched it so they now only have access to working age means tested benefits (for new claims). Mixed age couples now receive less money and the working age partner is covered by work search requirement rules (which they could previously avoid).

    You learn something new every day right?  Schedule 9 of the Universal Credit Regulations (2013), 'Circumstances in which a claimant is to be treated as having limited capability for work and work-related activity" outlines eligibility for LCWRA in claimants as including:

    Disabled and over the age for state pension credit

    5.  The claimant has reached the qualifying age for state pension credit and is entitled to attendance allowance, the care component of disability living allowance at the highest rate or the daily living component of personal independence payment at the enhanced rate.

    Whilst, this entitled.to webpage also confirms @calcotti 's advice about changes made to benefit entitlement in 2019 for mixed age couples.
