Hi everyone, I was assessed last April 2021 as LWC, reported that my conditions got worse july 2021, waited ages to be reassessed, finally had paper based assessment this year and awarded LCWRA. Uc are saying that the wait period for my backdated money still applies is this correct? As I thought because I was in lwc group previously that the wait period wouldn't apply?

You are correct. If you previously had LCW the LCWRA element should be paid from the start of the assessment period in which you reported the change in your health.

If it was a UC ‘adviser’ they aren’t advisers and often don’t know the rules.0

If you request a Mandatory Reconsideration it should be passed to a Decision Maker who should have a better knowledge of the rules.0

Just recieved msg off my case manager stating that I am only owed 1 month back pay as this was when I had to make a complaint because uc refused to reassess me before this, so the decision maker has awarded me lcwra from the date of complaint, surely this isn't right if I have been sending in continuous fit notes since last year0

If you reported a change of circumstances and been sending in fit notes without any gaps since last July then you should receive backdated money to that assessment period.You can request a Mandatory Reconsideration (MR) in your journal telling them you disagree with that decision not to backdate it. Tell them the exact date you reported the change. Adding that you believe it should be from the assessment period in which you reported the changes.0
