Care element backdating.

Hi guys, my partner started receiving carers allowance for me in April 2020, we noticed that UC were deducting that from our payment so assumed that meant they knew about it. I've recently found out about the care element and request it to be backdated to the start date of the carers allowance. Has anyone been successful with this? It's now in the hands of a decision maker. Any info would be greatly appreciated. Thanks.

Usually you have to report being a carer before the carers element is added. However, because your partner already claims carers allowance, if they were claiming UC the whole time since April 2020 then i see no reason why it can't be backdated. The only person that can make that final decision is a decision maker.1

Thanks for the reply, I spoke with C.A.B and they said the same thing and that theirs not really any way that they can say they didn't know. It'd certainly be nice if the decision maker see's it that way. Never really had any luck when it comes to universal credit so I thought I'd post here to see if anyone else has been through the same process. Thanks again.poppy123456 said:Usually you have to report being a carer before the carers element is added. The only time it won't be paid is if your partner is receiving the LCWRA element for theirself because the same person can't be paid both elements.

Ok, that's great news. I get lcwra but my partner that cares for me doesn't have any disabilities. Thanks again for taking the time to reply.poppy123456 said:The only time it won't be paid is if your partner is receiving the LCWRA element for theirself because the same person can't be paid both elements.0 -
It really makes no sense when someone claims carers allowance why the carers element isn't automatically added.

I agree, they automatically start deducting money when you recieve the carers allowance so you would think they could add the care element when they do that.poppy123456 said:It really makes no sense when someone claims carers allowance why the carers element isn't automatically added.0 -
