Tribunal for child DLA

May 24th dla stopped because on renewal they decided my 5 year old son was no longer entitled to the middle rate care he was receiving. I did a MR immediately and the DM rang on a Sunday and denied my son's award.

Since then I have taken it to tribunal and DWP since the 23rd July have not sent any paper work to me or the tribunal services. They were firstly given until the 1st September 2022 to respond, then a further 21 days up until the 23rd, again no response.

I have now recieved paperwork from the tribunal stating a direction has been put in place for the DWP to make contact with me or the tribunal or both, otherwise the hearing will be given a date and they will not be able to add any evidence.


Has anyone experienced this, total silence from the DWP....I mean I don't understand why they are ignoring the tribunal services.

     Unfortunately it does happen. As indicated the tribunal will proceed to make a decision even if the DWP still fail to respond.

    I really would like to hear from anyone who may have had this experience and whether DWP did contact them directly to consider an award or anything in the least!

    No idea about DLA, we don't often have members posting about DLA for children. For PIP they have been known to contact claimants to offer an award before the hearing takes place but this is rare, so you should expect to have to attend the hearing.

    Yes, i have a telephone hearing booked, but when I am still waiting yet and I know it may be a long wait.
